Шляхи покращення спеціального трудового законодавства, в якому закріплюються форми захисту трудових прав державних службовців

Abstract

Наголошено, що вдосконалення спеціального трудового законодавства, в якому закріплюються форми захисту трудових прав державних службовців найбільш доцільно вдосконалювати у наступних ключових напрямках: 1) нормативно-правовий напрямок. В рамках представленого вектору вбачається необхідним: а) розширити перелік законодавчо закріплених трудо-правових гарантій діяльності державних службовців; б) закріпити на нормативно-правовому рівні форми захисту трудових прав державних службовців, а також інструменти, способи та засоби їх реалізації; 2) процедурний напрямок, який повинен передбачити розробку процедурних механізмів, реалізації таких форм захисту трудових прав, як: самозахист та медіація.

The relevance of the article is that civil servants are a special category of employees, which is endowed with a set of powers that allow them to act on behalf of the state and perform its most important functions. Given the specifics of their work, the legislator must take a special approach to regulating their work, in particular in terms of protection guaranteed to them by the Constitution and other legislation, labor rights, freedoms and interests. However, in the field of protection of labor rights of civil servants there are a number of problems, the solution of which is virtually impossible without improving the rules of special labor legislation, which establishes forms of protection of labor rights of civil servants. The article, based on the analysis of scientific views of scientists, as well as a number of state concepts and programs, substantiates that today, both scientists and the legislator, quite inconsistent approach to solving problems of labor rights of civil servants. The author’s vision on the directions of improvement of the special labor legislation in which forms of protection of labor rights of civil servants are fixed is offered. It is concluded that the improvement of special labor legislation, which enshrines the forms of protection of labor rights of civil servants is most appropriate to improve in the following key areas: 1) regulatory area. Within the framework of the presented vector, it is considered necessary: a) to expand the list of legally established labor and legal guarantees for the activities of civil servants; b) to consolidate at the regulatory level the forms of protection of labor rights of civil servants, as well as tools, methods and means of their implementation; 2) procedural direction, which should include the development of procedural mechanisms, the implementation of such forms of protection of labor rights as: self-defense and mediation. The problem of collective protection of their labor rights by civil servants needs a separate solution; 3) the direction of logistical and financial support of civil servants; 4) improving the social protection of civil servants, which should include: expanding the list of social guarantees provided to both civil servants and their families.

Отмечено, что усовершенствование специального трудового законодательства, в котором закрепляются формы защиты трудовых прав государственных служащих, наиболее целесообразно совершенствовать в следующих ключевых направлениях: 1) нормативно-правовое направление. В рамках представленного вектора представляется необходимым: а) расширить список законодательно закрепленных трудо-правовых гарантий деятельности государственных служащих; б) закрепить на нормативно правовом уровне формы защиты трудовых прав государственных служащих, а также инструменты, способы и средства их реализации; 2) процедурное направление, которое должно предусмотреть разработку процедурных механизмов, реализации таких форм защиты трудовых прав, как: самозащита и медиация.
