Застосування процедур встановлення особи під час перетину адміністративних меж із тимчасово окупованою територією України

Abstract

Розглянуто обсяг та значення спеціальних процедур встановлення особи під час реалізації окремих норм Закону України «Про забезпечення прав і свобод громадян та правовий режим на тимчасово окупованій території України». Внаслідок дослідження окреслено систему нормативно-правових актів, які регулюють цей вид юридичної діяльності, та викладено алгоритм дій посадових осіб, що здійснюють цей вид юридичної діяльності, а також особливості правозастосування під час її здійснення.

The scope and the sense of special identification procedures while realizing certain provisions of the Law of Ukraine «On Guaranteeing Rights and Freedoms of Citizens and Legal Regime on Temporarily Occupied Territory of Ukraine» are studied. The system of legal acts regulating the proper type of legal work is determined in the research; officials’ algorithm of actions, carrying out this kind of legal activity as well as peculiarities of law enforcement during its realization are stated. In particular, appropriate amendments and alterations have been adopted, including those concerning legal relations arising in consequence of realizing by individuals their rights to enter and leave the temporarily occupied territories and directly related to the procedures of identifying these persons. It was found out that the activity of identification is estimated. It is carried out in each case to determine the reasons for making the decision about the permission to cross the administrative boundaries from the temporarily occupied territory of Ukraine. That is the official recognition or denial, confirmation or refutation by an official on behalf of the state, information about the person that is carried out within the legal activity of officials from the State Border Service of Ukraine with the use of procedural actions prescribed by the law.

Рассмотрены объём и значение специальных процедур установления личности при реализации отдельных норм Закона Украины «Об обеспечении прав и свобод граждан и правовой режим на временно оккупированной территории Украины». В исследовании определена система нормативно-правовых актов, регулирующих этот вид юридической деятельности, изложен алгоритм действий должностных лиц, осуществляющих этот вид юридической деятельности, а также особенности правоприменения во время её осуществления.
