Характеристика адміністративних процедур здійснення нагляду та контролю за охороною, захистом, використанням та відтворенням лісів в Україні

Abstract

У статті запропоновано авторське визначення поняття адміністративних процедур здійснення нагляду та контролю за охороною, захистом, використанням та відтворенням лісів в Україні. Розкрито зміст та значення відповідних процедур. Здійснено класифікацію адміністративних процедур здійснення нагляду та контролю за охороною, захистом, використанням та відтворенням лісів в Україні, які поділено на: 1) процедури, що виникають на етапі отримання дозвільних документів; 2) процедури втручального характеру, які і мають суто контрольний характер.Attention is focused on the fact that in the context of supervision and control over the protection, protection, use and reproduction of forests in Ukraine, the administrative procedure should be understood as the procedure laid down in legislation for the implementation of legally significant actions by authorized subjects and the adoption of relevant decisions regarding the verification and assessment of the conformity of the activities of controlled entities subjects to the requirements of current legislation in the field of protection and protection, use and reproduction of forests, as well as regarding the application to such subjects of certain response measures in case of need. The following types of administrative procedures in the supervision and control of protection, protection, use and reproduction of forests are distinguished: 1) control procedures at the stage of obtaining arbitrary documents; 2) interventional procedures, which have a purely control nature. It was noted that each of the specified types of administrative procedures for the supervision and control of the protection, protection, use and reproduction of forests in Ukraine has an internal structure (structure), namely: 1) the opening of proceedings, which take place through the adoption of a relevant procedural decision by an authorized subject about the start of a certain procedure; 2) direct control and supervision measures; 3) solving the case and making a decision based on the results of the control and supervision measures; 4) implementation of the decision made as a result of the inspection; 5) the procedure for carrying out a secondary check regarding the status (timeliness, completeness and quality) of the execution of the orders of the control bodies issued as a result of the primary (planned or unplanned) control. It is summarized that administrative procedures are an extremely important and indispensable tool for ensuring the legality and effectiveness of supervision and control over the protection, protection, use and reproduction of forests in Ukraine.В статье предложено авторское определение понятия административных процедур осуществления надзора и контроля над охраной, защитой, использованием и воспроизводством лесов в Украине. Раскрыты содержание и значение соответствующих процедур. Осуществлена классификация административных процедур осуществления надзора и контроля за охраной, защитой, использованием и воспроизводством лесов в Украине, которые разделены на: 1) процедуры, возникающие на этапе получения разрешительных документов; 2) процедуры вмешательства, которые и имеют чисто контрольный характер.
