Криміналістична класифікація типових способів і слідів порушення недоторканності житла

Abstract

Розроблено криміналістичну класифікацію способів порушення недоторканності житла, встановлено й узагальнено найбільш поширені у практиці прийоми і операції, що застосовуються правопорушниками, а також систематизовано типові сліди досліджуваного виду кримінального правопорушення. Визначено, що типові способи та сліди порушення недоторканності житла варто розглядати як єдиний елемент криміналістичної характеристики кримінального правопорушення, тому що у слідчій практиці спосіб встановлюють шляхом дослідження залишених слідів. Встановлено, що способи цього виду кримінального правопорушення переважно не містять етапів підготовки та приховування. Типові способи безпосереднього вчинення таких деліктів варто класифікувати залежно від прийомів проникнення до житла чи іншого володіння особи, обсягу вчинених протиправних дій, кількості правопорушників і тривалості протиправної поведінки. Зазначено, що типові сліди порушення недоторканності житла доцільно поділити на такі групи: сліди на місці події, сліди на підозрюваному та, іноді, на потерпілому, сліди-документи, сліди-предмети та цифрові сліди, сліди в пам’яті очевидців події.

Violation of the inviolability of housing (Article 162 of the Criminal Code of Ukraine) is a common type of criminal offense. However, the methodology of its investigation has not been established yet. It is a drawback in forensic science since investigators do not have scientifically justified recommendations for their implementation in practice. The information background of the relevant methodology should be the criminalistics characteristics of the given type of criminal offense, which is primarily based on the analysis of the investigative and judicial practice. The most significant points in this characteristic are typical methods and traces of a criminal offense. The information about the typical methods and traces of a certain type of criminal offense has both theoretical (as a basis for developing scientific recommendations) and practical (as a guideline for choosing the means of proof) value. Therefore, the definition of the content and systematization of these elements of the criminalistics characteristics of violation of the inviolability of housing is an important scientific task. For its solution in the article, based on the analysis of scientific literature, and generalization of investigative and judicial practice, the authors identified the typical methods and traces of violation of the inviolability of housing as elements of the criminalistics characteristics of this type of criminal offense. The criminalistics classification of methods of violation of the inviolability of housing is developed, the most common in-practice techniques and operations used by offenders are identified and summarized, and the typical traces of the type of criminal offense under study are systematized. The authors concluded that the common methods and traces of violation of the inviolability of housing should be considered as a single unit of the criminalistics characteristics of this criminal offense as the method of crime in investigative practice is established by examining the traces left behind. After analyzing the scientific literature and the investigation practice of violation of the inviolability of housing, the authors determined that the methods of this type of criminal offense mainly do not contain the stages of preparation and concealment. Depending on the form of violation of the inviolability of housing, the typical ways of intrusion into housing, ways of committing illegal actions in housing, ways of illegal eviction from housing, ways of illegal settlement in someone else’s housing, and other related actions are identified. Depending on the techniques applied by the offender, the typical methods and operations of covert and open intrusion into housing are distinguished. According to the volume of committed illegal actions, the ways of direct violation of the inviolability of housing and other related violent, mercenary or hooligan actions are differentiated. By the number of offenders, the ways of individual and group violation of the inviolability of housing were identified. Depending on the duration of the illegal behavior, it is proposed to distinguish the ways of short and long-term criminal offenses. The authors offer to divide the typical traces of violation of the inviolability of the housing into the following groups: traces at the scene, traces on the suspect and the victim, traces-documents, traces-objects and digital traces, traces in the memory of eyewitnesses.

Разработана криминалистическая классификация способов нарушения неприкосновенности жилья, установлены и обобщены наиболее распространенные в практике приемы и операции, применяемые правонарушителями, а также систематизированы типичные следы исследуемого вида уголовного правонарушения. Определено, что типовые способы и следы нарушения неприкосновенности жилья следует рассматривать как единственный элемент криминалистической характеристики уголовного правонарушения, так как в следственной практике устанавливают способ путем исследования оставленных следов. Установлено, что способы этого вида уголовного преступления в основном не содержат этапов подготовки и сокрытия. Типичные способы непосредственного совершения таких деликтов следует классифицировать в зависимости от приемов проникновения в жилище или иного владения личности, объема совершенных противоправных действий, количества правонарушителей и длительности противоправного поведения. Отмечено, что типовые следы нарушения неприкосновенности жилья целесообразно разделить на следующие группы: следы на месте происшествия, следы на подозреваемом и иногда на потерпевшем, следы-документы, следы-предметы и цифровые следы, следы в памяти очевидцев происшествия.
