dc.description.abstractПроаналізовано контрольні повноваження суду у виконавчому провадженні, їх особливості, правову природу та юридичні наслідки. Досліджено механізми здійснення судового контролю за виконанням судових рішень з метою виявлення неузгодженостей та системних помилок діючого законодавства, яким врегульовані процедурні аспекти порядку застосування контрольних повноважень у виконавчому провадженні судовим органом. Висвітлено проблемні аспекти практичного здійснення судового контролю за виконанням судових рішень у цивільному судочинстві, який покликаний забезпечити виконання ухваленого судового рішення.
dc.description.abstractThe article is devoted to the current problems of legal regulation of the powers of judicial control over executive proceedings in civil procedural and other branch legislation. Gaps in the current legislation in the field of regulation of the control powers of judicial bodies in executive proceedings and the practical exercise of control powers by the judicial body at the stage of enforcement of court decisions in civil proceedings were noted. Attention is drawn to the general grounds for judicial control in various branches of the judiciary, the legal norms regulating legal relations related to the enforcement of court decisions and judicial control over their execution are noted. Problematic aspects of the practical implementation of judicial control over the execution of court decisions in civil proceedings, which is designed to ensure the execution of the adopted court decision, are highlighted. The functions of judicial control over the execution of acts of justice in civil proceedings are expressed exclusively in the procedural actions of the court, related to the consideration of complaints against the decisions, actions or inaction of executors or other bodies, whose competence includes the enforcement of court decisions and undoubtedly require the expansion of mechanisms for the implementation of control powers of judicial bodies at the stage of enforcement of acts of justice, especially in civil proceedings. It was concluded that judicial control over enforcement proceedings in civil procedural legislation is aimed at restoring the already violated right of the party to enforcement proceedings, which is its drawback, and does not provide for control powers of the judicial body aimed directly at the execution of the court decision by the debtor. It is proved that judicial control at the stage of enforcement of a court decision should be directed, first of all, to the control of actions (inaction) of the debtor in enforcement proceedings, and therefore, in our opinion, the debt collector should have the possibility of applying to the body established at the legislative level of the judiciary in order to establish judicial control directly over the execution of the court decision by the debtor.
dc.description.abstractПроанализированы контрольные полномочия суда в исполнительном производстве, их особенности, правовую природу и юридические последствия. Исследованы механизмы осуществления судебного контроля за исполнением судебных решений с целью выявления несогласованностей и ошибок действующего законодательства, которым урегулированные процедурные аспекты порядка применения контрольных полномочий в исполнительном производстве судебным органом. Освещены проблемные аспекты практического осуществления судебного контроля за исполнением судебных решений в гражданском судопроизводстве, который призван обеспечить исполнение принятого судебного решения.
