Поняття і значення реєстраційних та дозвільноліцензійних процедур у діяльності Національної поліції

Abstract

Досліджено сутність реєстраційних і дозвільно-ліцензійних процедур у діяльності Національної поліції, виходячи зі специфіки публічно-сервісної діяльності останньої та особливостей надання поліцейських послуг. Виокремлено низку спільних ознак реєстраційних та дозвільно-ліцензійних процедур, а також запропоновано дефініцію «реєстраційні та дозвільно-ліцензійні процедури в діяльності Національної поліції» − послідовні легалізовані дії сервісного характеру, які здійснюються органами поліції в процесі надання ними поліцейських послуг, по завершенню яких фізична або юридична особа отримує документ (дозвіл або ліцензію), що дозволяє проводити різноманітні операції з об’єктами дозвільної системи, предметами індивідуального захисту й активної оборони або ж надавати специфічні послуги, зокрема з охорони, обслуговування стрільбищ, перевезення надгабаритних вантажів.

The absence of sufficient theoretical developments regarding the essence and content of registration, permit and license procedures provided by the National Police of Ukraine is emphasized. In this regard, the following research tasks were formulated: 1) to establish the specificity of the legal nature of registration and permit-lic ensing procedures as a public service activity of police bodies; 2) determine the content of the categories “services” and “administrative services”, a s well as outline their characteristic features.The implementation of the outlined tasks is aimed at achieving thegoal, which consists in forming the author’s definition of the concept of “registration and permit-licens ing procedures in the activities ofthe National Police” and clarifying their significance for ensuring the functioning of the permit system .Attentio n is focused on the presence of a set of common features of registration and permit-licensing procedures in the activities of the National Police, in particular: this is a sequence of actions regulated by current national legislation; they are ca rried out by a specific entity, a law enforcement agency - the Nati onal Police of Ukraine; in theiressence they area public service activity ; the res ult of such procedures involves mandatory documentation – obtaining a document (permit or license) and/ormaking changes to registration documents or information databases; they mainly take place in the field of the permit system; they are implemented within the framework of the provision of paid services by police bodies; the initiator s of these procedures are individuals and legal entities; they are carried out in relation to individual objects of the permit system and pyrotechnic devices,the manufactureof special devices loaded with tear and irritant substances, individual protection, active defense, the provision of services for the protection of property and citizens, as well as certain types of activities (transportation of oversized,heavy cargo, activities related to the provision of services by shooting ranges, etc.).The auth or’s definition of the concept of “registration and permit-licensing procedures in the activities of the National Police”has beenproposed– these are successive legalized actions of a service nature, which are carried out by police bodies in the process of providing police ser vices, upon completion of which an individual or legal entity receives a document (permit or license), which allows you to carry out various operationswith objects of the permit system, items of individual protection and active defense, or provide specific services, in particular, guarding, maintenance of shooting ranges, transportation of oversized cargo.

Исследована сущность регистрационных и разрешительно-лицензионных процедур в деятельности Национальной полиции исходя из специфики публично-сервисной деятельности последней и особенностей предоставления полицейских услуг. В результате выделен ряд общих признаков регистрационных и разрешительно-лицензионных процедур, а также предложена дефиниция понятия «регистрационные и разрешительно-лицензионные процедуры в деятельности Национальной полиции» – это последовательные легализованные действия сервисного характера, которые осуществляются органами полиции в процессе предоставления ими полицейских услуг, по завершению которых физическое или юридическое лицо получает документ (разрешение или лицензию), позволяющий проводить различные операции с объектами разрешительной системы, предметами индивидуальной защиты и активной обороны или предоставлять специфические услуги, в частности по охране, обслуживанию стрельбищ, перевозке сверхгабаритных грузов.
