Засади надання та реалізації правової допомоги

Abstract

У статті наголошено на необхідності з’ясування сутності та критеріїв класифікації засад надання та реалізації правової допомоги з урахуванням як наукових напрацювань, так і нормативно-правових положень з метою визначити теоретичні та прикладні проблеми інституту професійної правничої допомоги в кримінальному процесі України.

In the article, it has been emphasized the need to clari- fy the essence and criteria for classifying the principles of providing and implementing legal aid, taking into account both scientific developments and regulations in order to identify theoretical and applied problems of the institute of professional legal assistance in criminal proceedings in Ukraine. It has been emphasized that the principles of providing and implementing legal aid have a decisive influ- ence on the further development of these public relations, as their non-compliance or violation may call into question the legality and validity of final procedural decisions. The conceptual and categorical apparatus used in the present- ed research has been specified. It has been found that the provision and implementation of legal aid both within the criminal process and in general within the relevant public relations is based on a number of principles, which should be classified depending on the scope of their distribution. It is has been suggested that in this case, first of all, we should talk about the common law principles of providing and implementing legal aid, among which we mentioned the rule of law, legality and equality. Such principles have become widespread and determine any legitimate activity, including law enforcement. The second group of principles of providing and implementing legal aid consists of intersectoral principles, which are manifested in the im- plementation of the investigated activities within the relevant court proceedings (administrative, civil, commercial, criminal), as well as pretrial activities. Such principles include accessibility, quality assurance, guaranteed pub- lic funding, independence, confidentiality (including legal secrecy), avoidance of conflicts of interest (potential and real). The last group of principles of providing and implementing legal aid has been represented by sectoral principles, which are manifested in the implementation of criminal proceedings – the presumption of innocence, ensuring the right to protection, access to justice.

В статье отмечена необходимость выяснения сущности и критериев классификации принципов предоставления и реализации правовой помощи с учетом как научных наработок, так и нормативно-правовых положений с целью определить теоретические и прикладные проблемы института профессиональной юридической помощи в уголовном процессе Украины.
