Анотація
Запропоновано авторське визначення понять компетенція та повноваження керівника Державного бюро розслідувань. Здійснено аналіз норм чинного законодавства, на основі чого надано змістовну характеристику повноваженням та компетенції керівника Державного бюро розслідувань як суб’єкта забезпечення дисципліни та законності. Доведена необхідність внесення змін до статті 12 Закону України «Про Державне бюро розслідувань», в межах якої варто закріпити вичерпний перелік повноважень директора ДБР
здійснивши їх класифікацію наступним чином: 1) повноваження в сфері організації діяльності
Державного бюро розслідувань; 2) повноваження в сфері кадрового забезпечення Державного
бюро розслідувань; 3) контрольні повноваження директора ДБР; 4) повноваження в сфері підтримки службової дисципліни і стану законності в роботі органів та підрозділів Бюро.
It is argued that the competence of the head of the State Bureau of Investigations, as a subject of ensuring legality and discipline, includes: fi rstly, the implementation of rule-making work aimed at improving the activities of the State Bureau of Investigations in general and personnel processes at all levels of the service in particular, and as well as the implementation of measures to strengthen offi cial discipline and legality in the Bureau, prevention of offenses by the personnel of the body, etc.; secondly, the resolution of issues regarding the encouragement of DBR employees, as well as bringing them to disciplinary compliance in accordance with the procedure established by the legislation, as well as by departmental regulatory and legal acts; thirdly, management of the activities of internal services and departments, the purpose of which is to control and coordinate the work of the structural elements of the SBI, as well as to detect and stop offenses in their work; fourth, coordination of the activities of the heads of structural and territorial bodies of the SBI at all levels; fi fth, the organization, provision and control of internal fi nancial processes in the structure of the DBR for the purpose of correct and targeted use of budget funds and prevention of abuse. It is emphasized that the peculiarity and, at the same time, the problematic nature of the powers ofthe head of the State Bureau of Investigation, as a subject of ensuring legality and discipline, is that they are soluble in normative acts that regulate the work of the investigated law enforcement body and are not systematized in any way, although they make up a signifi cant share from the total number of his powers. The need to amend Article 12 of the Law of Ukraine “On the State Bureau of Investigations” has been proven, within which it is necessary to establish an exhaustive list of the powers of the director of the SBI, classifying them as follows: 1) powers in the fi eld of organization of the activities of the State Bureau of Investigations; 2) powers in the fi eld of staff support of the State Bureau of Investigation; 3) control powers of the director of the DBR; 4) powers in the fi eld of maintaining offi cial discipline and the state of legality in the work of the Bureau’s bodies and divisions.
Предложено авторское определение понятий компетенция и полномочия руководителя Государственного бюро расследований. Осуществлен анализ норм действующего законодательства, на основе чего предоставлена содержательная характеристика полномочий и компетенции руководителя Государственного бюро расследований как субъекта обеспечения дисциплины и законности.
