dc.description.abstract | Дисертацію присвячено дослідженню правових засад стимулювання трудової активності працівника та аналізу правової природи такого стимулювання. У роботі охарактеризовано сутність нормування праці та його роль у підвищенні продуктивності праці. Розкрито стимулюючу роль оплати праці та можливості матеріального і нематеріального стимулювання працівника до трудової активності. Охарактеризовано участь працівників в управлінні підприємством як спосіб об’єднання економічних інтересів працівників і роботодавця. Розкрито значення дисципліни праці в контексті підвищення продуктивності праці. Висвітлюються суть та значення професійного розвитку працівника через підвищення його кваліфікації. Робота супроводжується пропозиціями щодо вдосконалення трудового законодавства, яке регулює питання, пов’язані із правовим стимулюванням трудової активності працівника. | uk_UA |
dc.description.abstract | The dissertation is focused on the problems of increasing the labor activity of an employee by means of legal stimulation. The dissertation research consists of three sections containing 10 subdivisions, conclusions and references. Theoretical principles of legal stimulation of labor activity of an employee are researched in the context of revealing the concept and essence of legal stimulation of labor activity; determining the organization of work in enterprises, institutions in the modern conditions of the development. Particular attention has been paid to standardization of labor and opportunities to increase the efficiency of production. The key theoretical and practical problems of legal stimulation of an employee’s labor activity have been determined. The author of the paper has argued the idea that under the legal stimulation of labor activity of an employee we should understand the system of special sectoral methods, techniques and means of encouraging employers to implement specific legal models of labor organization at enterprises, institutions, organizations that are enshrined in labor legislation, local acts and contracts in the labor field for creating legal conditions and opportunities for an employee to increase working efficiency and productivity. The author of the thesis supports the idea that atypical forms of employment that are becoming widespread in Ukraine can be used to increase the labor activity of the population in the whole. In particular, for the organization of the process of socially-beneficial work of employees, which combine the work with the care over a family member for employees with disabilities, for employees of creative occupation, etc. Payment for labor and its stimulating role in the process of increasing labor activity has been revealed through the definition of legal opportunities for remuneration for work to increase the labor activity of an employee. It has been substantiated that the stimulating role of the payment for labor has been revealed through a combination of material and non-material stimulation of an employee’s labor activity, which makes it possible: (a) to provide an employee’s interest in increasing the working efficiency, depending on his personal needs and abilities to work; and (b) to ensure the personal professional development of an employee, his cultural and spiritual enrichment; (c) to meet socio-economic needs of an employee. The means of material and non-material stimulation of an employee’s labor activity has acquired independent coverage. Special attention has been paid to international experience of such stimulation in order to increase working efficiency. The author has proved the opinion that the stimulating function of wages is effectively implemented through a combination of material and non-material incentives, in terms of specification in getting this reward by an employee in social partnership acts. The author has emphasized on the characteristics of the legal possibilities of collective and contractual labor regulation to increase the labor activity of an employee in order to increase working efficiency. Based on the progressive experience of the countries with developed economies, the author has offered to spread the introduction of a “social package” for employees to increase their labor activity. The social package has been characterized as an integrated legal mean of contractual nature, which ensures the implementation of mutual social and economic interests of an employee and employer through changing the quality of the employee’s labor life by providing him with additional labor and social rights, in comparison with the legislation, by increasing his labor activity and working efficiency more than a certain norm of labor. The author of the paper has emphasized that individual ways of increasing the labor activity of employees are their participation in the management of the enterprise, institution, organization; strengthening the labor discipline and raising the level of employees’ qualification, in particular at the expense of an employer. It has been argued that the participation ofemployees in the management of an enterprise creates the legal way of realizing the socio-economic interests of the members of the labor collective through the consolidation of the legal capabilities of the labor collective to obtain additional rights to distribute profits of an enterprise in comparison with labor legislation, depending on the results of increasing working efficiency because of the labor activity of employees. It has been substantiated that the labor discipline is one of the ways to increase the labor activity of employees, and its strengthening is a prerequisite for the growth of working efficiency, since the disorganization of the collective labor process makes it impossible to increase the working efficiency of the whole labor collective. In order to create the necessary labor conditions for the growth of its productivity we should involve two subjects – an employer and labor collectives into the process of ensuring the labor discipline. The author of the paper has proved that qualification improvement as a form of increasing an employee’s labor activity is a continuous process of improving his practical skills and gaining new knowledge and skills and one of the ways of developing his personal abilities for work, which in turn indicates the economic qualities of raising the level of skills in order to meet economic interests of both an employee and an employer. The socioeconomic effect from professional development of an employee can be realized through social-partnership relations by establishing the corresponding rights and obligations of social partners in the relevant acts of social partnership (collective agreements and contracts, etc.). The paper is accompanied by propositions to improve labor legislation that regulates the issues related to the legal stimulation of the employee’s labor activity. | en |

Охарактеризованы участие работников в управлении предприятием как способ объединения экономических интересов работников и работодателя. Раскрыто значение дисциплины труда в контексте повышения производительности труда. Освещаются суть и значение профессионального развития работника в связи с повышением его квалификации. Работа сопровождается предложениями по совершенствованию трудового законодательства, регулирующего вопросы, связанные с правовым стимулированием трудовой активности работника. | ru |
