Теоретико-методологічні засади дослідження участі адвоката у здійсненні міжнародного співробітництва під час кримінального провадження

Abstract

Для комплексного аналізу особливостей участі адвоката у здійсненні міжнародного співробітництва під час кримінального провадження обґрунтовано використання системи загальнонаукових, спеціальних і конкретнонаукових методів пізнання, за допомогою яких формується понятійний апарат, розкривається специфіка правовідносин із урахуванням положень міжнародного та національного законодавства. Досліджено визначення засад участі адвоката у здійсненні міжнародного співробітництва під час кримінального провадження.The scientific article highlights the theoretical and methodological principles of the study of the participation of a lawyer in the implementation of international cooperation in criminal proceedings. A review of literature sources showed that today scientific research has been carried out in two directions: first, a number of studies related to the functioning of the bar; secondly, some works are devoted to the scientific understanding of the content of international cooperation in criminal proceedings. It is stated that there are no scientific works that would cover the issue of participation of a lawyer in the implementation of international cooperation in criminal proceedings. Scientific research was aimed at solving this complex problem. The methodology of research of the lawyer’s participation in the implementation of international cooperation in criminal proceedings should be considered as a system of scientific theoretical and practical ways to achieve the goals and objectives of the study. Methods of scientific cognition are involved in this system, the theoretical and empirical base of research is used, the set purpose and tasks of scientific work are solved. For a comprehensive analysis of the peculiarities of a lawyer’s participation in international cooperation in criminal proceedings, the use of a system of general, special and specifically scientific methods of cognition is substantiated, by means of which the conceptual apparatus is formed, It is guided by these and other theoretical and methodological provisions that we consider it necessary to conduct research to determine the principles of participation of a lawyer in the implementation of international cooperation in criminal proceedings.Для комплексного анализа особенностей участия адвоката в осуществлении международного сотрудничества в ходе уголовного производства обосновано использование системы общенаучных, специальных и конкретнонаучных методов познания, с помощью которых формируется понятийный аппарат, раскрывается специфика правоотношений с учетом положений международного и национального законодательства. Исследовано определение принципов участия адвоката в осуществлении международного сотрудничества в ходе уголовного производства.
