Анотація
Досліджено та порівняно основні нормативно-правові акти, що визначають порядок запровадження та реалізації заходів воєнного стану під час Другої світової війни та на сучасному етапі. Наголошено, що правові положення цих документів з одного боку є схожими між собою, оскільки врегульовують особливий порядок суспільних відносин в умовах правової дійсності, викликаної бойовими діями, а з іншого, вони мають свої особливості, зміст яких обумовлюється рівнем розвитку нормотворчих органів та специфічним режимом правового регулювання, у якому концентрується юридична своєрідність періоду їх прийняття та чинності.
The article is devoted to a comparative analysis of legislation on martial law during World War II and today. The work examines and analyzes the Decree of the Presidium of the Supreme Soviet of the USSR «On Martial Law» dated 22.06.1941 and the Law of Ukraine «On the Legal Regime of Martial Law» dated 12.05.2015, which are basic legal acts in the sphere of regulating social relations during the martial law regime. It is noted that the relevance of comparative analysis of the above-mentioned acts is caused by special interest of society in both wars, in view of the above, the purpose of our research was to study the historical and legal foundations of the development of legislation on martial law at the current stage and in historical retrospect. It was established that both documents have both common features and characteristic differences. In particular, both the Decree of 1941 and the law of 2015 have a common subject of legal regulation, as they regulate social relations that take place under conditions of martial law. Also, the norms of the researched normative legal acts define military management bodies and their powers, and also place the duty on state bodies, public organizations and citizens to support these bodies. Attention is drawn to the fact that, despite certain similarities between the Decree of the Presidium of the Supreme Soviet of the USSR «On Martial Law» dated June 22, 1941 and the Law of Ukraine «On the Legal Regime of Martial Law» dated May 12, 2015, each of them has its own specific features. It was determined that the law of Ukraine of 2015 is more perfect in terms of legal technique, both in terms of form, content and logic of setting out legal norms. At the same time, the Decree of 1941 is dominated by prohibition norms, and most of the provisions are blanket in nature, creating conditions for state authorities and law enforcement agencies to interpret legal provisions at their own discretion. Based on the results of the research, it was concluded that the legal norms of the Decree of the Presidium of the Supreme Soviet of the USSR «On Martial Law» dated 22.06.1941 and the Law of Ukraine «On the Legal Regime of Martial Law» dated 12.05.2015, on the one hand, are similar to each other, as they have the common subject of legal regulation, and on the other hand, they have their own characteristics, reflecting the legal validity of the historical period in which they were adopted.
Исследованы и сравнены основные нормативно-правовые акты, определяющие порядок внедрения и реализации мероприятий военного положения во время Второй мировой войны и на современном этапе. Отмечено, что правовые положения этих документов с одной стороны схожи между собой, поскольку регулируют особый порядок общественных отношений в условиях правовой действительности, вызванной боевыми действиями, а с другой, они имеют свои особенности, содержание которых обуславливается уровнем развития нормотворческих органов и специфическим режимом правового регулирование, в котором концентрируется юридическое своеобразие периода их принятия и действия.
