Принципи забезпечення прав людини в правоохоронній діяльності

Abstract

У статті, спираючись на аналіз наукових поглядів учених, з’ясовано сутність таких понять, як: принципи та принципи права, на основі чого запропоновано авторське визначення принципів забезпечення прав людини у правоохоронній діяльності. Виокремлено та надано характеристику ключовим принципам забезпечення прав людини у правоохоронній діяльності, а також обґрунтовано доцільність їх закріплення на законодавчому рівні.

It was found that law enforcement activity is the activity of specially authorized entities defined by the norms of current legislation, which involves the implementation of a set of measures by them using a number of tools and means, and which is aimed at: a) prevention of violations of the rights and freedoms of citizens; b) termination of offenses; c) identification of reasons that could lead to violations of the rights, freedoms and interests of a person and a citizen. It is argued that the principles of ensuring human rights in law enforcement activities represent the starting principles (ideas), key requirements that underlie the appropriate provision. It is noted that the relevant principles form not only the ideological basis for the implementation of the relevant activity, but also determine the directions of its implementation and prospects for further development. Compliance with the principles of ensuring human rights in law enforcement activities is mandatory for all participants in the relevant legal relationship, and deviation from them may entail the onset of legal liability. The following key principles of ensuring human rights in law enforcement activities are singled out and characterized: the rule of law, legality, personal integrity, equality and equity; tolerance and non-discrimination. The importance and necessity of legislative consolidation of the above-mentioned principles is substantiated.

В статье, опираясь на анализ научных взглядов ученых, выяснена сущность таких понятий, как: принципы и принципы права, на основе чего предложено авторское определение принципов обеспечения прав человека в правоохранительной деятельности. Выделена и предоставлена ​​характеристика ключевых принципов обеспечения прав человека в правоохранительной деятельности, а также обоснована целесообразность их закрепления на законодательном уровне.
