dc.description.abstractНа підставі аналізу наукових точок зору та відповідних нормативно-правових актів розроблено авторське бачення статусу адвокатури України як об’єкта адміністративно-правового забезпечення. Встановлено, що правова допомога, яка надається адвокатами, повинна розглядатись законодавством як кваліфікована, з обов’язковим закріпленням даної дефініції на законодавчому рівні.ru_RU.UTF8
dc.description.abstractIt is established that private and public interests are combined within advocacy activity: private interests of a particular person, whose rights are protected by a lawyer and public interest of society directed on keeping the rule of law, human rights and freedoms by the state. The construction of a legal state, which Ukraine declared itself, does not begin with the declaration of these rights in the Constitution of the country, but from keeping the rights of each individual citizen. The analysis of scientific opinions and relevant regulations is realized; the author’s point of view of the status of the advocacy in Ukraine as an object of administrative and legal guaranteeing is elaborated. Besides, it is determined that the legal aid provided by attorneys, must be considered by the legislation as qualified with a mandatory consolidation of this definition on the legislative level. The author has analyzed domestic regulations and noted that the range of organizations and individuals providing legal aid to the population in Ukraine is quite wide, where advocacy has a significant (and in criminal proceedings – basic) share of the load in the provision of legal aid. It is grounded that the advocacy serves at the same time as a partner of the state, which has taken the guarantee to ensure the right of citizens on qualified legal aid. As a guaranteeing mechanism the state uses the advocacy institution. Thus, special social functions the state rests on the advocacy.en
dc.description.abstractНа основании анализа научных точек зрения и соответствующих нормативно-правовых актов разработано авторское виденье статуса адвокатуры Украины как объекта административно-правового обеспечения. Установлено, что правовая помощь, которая предоставляется адвокатами, должна рассматриваться законодательством как квалифицированная, с обязательным закреплением данной дефиниции на законодательном уровне.ru
