Теоретико-правові особливості дигіталізації виконавчої влади України як правового процесу

Abstract

Стаття присвячена теоретико-правовому аналізові процесу дигіталізації системи виконавчої влади в контексті модернізації державного управління й реалізації заходів з адміністративної реформи в сучасній Україні в розрізі впровадження концепції електронного урядування та із виокремленням основних етапів і правових закономірностей такого процесу. Показано, що дигіталізація виконавчої влади в Україні є соціально-правовим процесом, що триває, і обіймає значний період часу, розпочавшись практично від перших років здобуття Україною незалежності.The article is devoted to the theoretical and legal analysis of the process of digitization of the executive power system in the context of the modernization of state administration and the implementation of administrative reform measures in modern Ukraine, in the context of the introduction of the concept of electronic governance and highlighting the main stages and legal patterns of such a process. It is shown that the digitalization of the executive power in Ukraine is a socio-legal process that continues and spans a significant period of time, starting almost from the first years of Ukraine's independence. Strategically, it envisages such a way of implementing executive power, which is conditioned by the systematic introduction of ICT into the practice of its activities. In the course of digitalization, the current rule-making of the subjects of digitalization was also combined; hierarchically, such law-making took place at the level of laws of Ukraine, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine and central executive bodies. The digitalization of executive power maintains high dynamics and over time covers an increasingly wider range of social relations with its regulatory influence. The key directions of digitalization of executive power in Ukraine were: ensuring the functioning of websites of executive power bodies of all levels based on uniform standards, their unification and standardization; creation and introduction of a unified state-wide system of electronic document circulation in the bodies of executive power; creation and improvement of the functioning of a single system of public electronic registers, which are managed by executive authorities; ensuring the provision of administrative services by executive authorities in electronic form to citizens and business entities in various spheres of public life; creation of the Unified web portal of administrative services of executive authorities; provision of conditions for the introduction of ICT in administrative procedures of executive authorities, institutionalization of electronic administrative procedure and electronic rule-making; creation of conditions for electronic participation of citizens, their associations and business entities in the process of preparation of state decisions by executive authorities; implementation and development of technologies for electronic interaction of executive authorities and their officials with citizens and business entities.Статья посвящена теоретико-правовому анализу процесса дигитализации системы исполнительной власти в контексте модернизации государственного управления и реализации мер по административной реформе в современной Украине в разрезе внедрения концепции электронного управления и с выделением основных этапов и правовых закономерностей такого процесса.
