Можливості імплементації зарубіжного досвіду правового регулювання охорони праці працівників поліції у вітчизняні реалії

Abstract

Здійснено аналіз позитивного зарубіжного досвіду правового регулювання охорони праці працівників поліції. Акцентовано увагу на тому, що важливим фактором охорони праці поліцейських у країнах ЄС є їх психологічна безпека, забезпечення можливості психологічної реабілітації, створюючи при цьому захист від професійного вигорання. Сформовано авторське бачення щодо напрямів імплементації зарубіжного досвіду правового регулювання охорони праці працівників поліції у вітчизняні правові реалії. Особливе значення в процесі забезпечення охорони праці поліцейських, зокрема в США, відіграють поліцейські профспілки, які приймають активну участь в лобіюванні інтересів працівників поліції у створенні безпечних умов праці, поліпшення якості надання медичних послуг, реабілітації, захисту законних інтересів членів профспілок у відносинах з наймодавцями (наприклад, з МВС, органами місцевого самоврядування щодо муніципальної поліції).

The article, based on the analysis of scientific views of scientists, analyzes the positive foreign experience of legal regulation of labor protection of police officers. Emphasis is placed on the fact that an important factor in the protection of police officers in the EU is their psychological safety, ensuring the possibility of psychological rehabilitation, while creating protection against burnout. The author’s vision on the directions of implementation of foreign experience of legal regulation of labor protection of police officers in the domestic legal realities is formed. Police unions are particularly important in protecting the health of police officers, particularly in the United States. for example, with the Ministry of Internal Affairs, local governments in relation to the municipal police). An important factor in the protection of police officers in the EU is their psychological safety, providing opportunities for psychological rehabilitation, while creating protection against burnout. The following areas can be identified as ways to apply foreign experience in Ukraine: organization of training of police officers on knowledge and skills of labor protection at all stages of their graduate and postgraduate education; organization and conduct of courses and programs that cover issues of labor protection, taking into account the specifics of the professional activities of police officers of certain units; increasing the role of police unions in the establishment and implementation of labor protection measures; the creation of a «hot line» similar to the one in the United States, in which the employee can report violations of labor protection requirements both electronically and by telephone; development of health insurance for life and health of police officers; paying attention to the legal regulation of ensuring the psychological health of police officers as a necessary component of their protection, in particular by instructing police officers on the possibility of obtaining professional psychological assistance and, accordingly, providing such an opportunity; to oblige the heads of structural subdivisions to monitor the psychological state of subordinates, etc.

Проведен анализ положительного зарубежного опыта правового регулирования охраны труда работников полиции. Акцентировано внимание на том, что важным фактором охраны труда полицейских в странах ЕС является психологическая безопасность, обеспечение возможности психологической реабилитации, создавая при этом защиту от профессионального выгорания. Сформировано авторское видение направлений имплементации зарубежного опыта правового регулирования охраны труда работников полиции в отечественные правовые реалии. Особое значение в процессе обеспечения охраны труда полицейских, в частности в США, играют полицейские профсоюзы, которые активно участвуют в лоббировании интересов работников полиции в создании безопасных условий труда, улучшении качества предоставления медицинских услуг, реабилитации, защиты законных интересов членов профсоюзов в отношениях с наймодателями ( например, с МВД, органами местного самоуправления по муниципальной полиции).
