Нормативні засади діяльності органів прокуратури України

Abstract

Здійснено спробу проаналізувати чинне законодавство, що регулює діяльність органів прокуратури щодо протидії корупції в Україні. Приділено увагу тлумаченню терміну «нормативно-правове регулювання» та відзначено, що його розуміння в юридичній літературі неоднозначне та суперечливе. Підкреслено, що з метою законодавчого забезпечення діяльності органів прокуратури розроблено низку нормативних актів, які в тій чи іншій мірі регулюють діяльність даного органу, спрямовану на протидію корупції в Україні. Вони відрізняються один від одного за багатьма ознаками: юридичною силою, назвою, порядком прийняття, порядком набрання чинності та дії тощо. Окрему увагу приділено впливу міжнародних правових актів, ратифікованих у встановленому порядку, на правову основу діяльності прокуратури щодо протидії корупції в Україні.

The author of this article has attempted to analyze the current legislation regulating the activities of prosecutor’s office agencies in combating corruption in Ukraine. Special attention is paid to the interpretation of the term of “normative and legal regulation”; it has been also noted that its understanding within the legal literature is ambiguous and contradictory. It is emphasized that in order of the legal provision of the activities of the prosecutor’s office agencies a number of regulations that in one way or another regulate the activity of this agency aimed at combating corruption in Ukraine has been developed. They differ from each other in many features: legal force, title, procedure of adoption, procedure of entry into force and action, etc. It is noted that it is the Constitution of Ukraine laid the foundations for further legislative and rule-making activities of the state agencies aimed at ensuring the rights and freedoms of citizens, improving the existing legal system and combating corruption. Some legislative acts that regulate the activity of the prosecutor’s office in the field of fight against corruption and, above all, the Law of Ukraine “On Prosecutor’s Office” and the Law of Ukraine “On Corruption’s Prevention” have been analyzed. Special attention is paid to the impact of international legal acts ratified by the established procedure, to the legal basis of the activities of the prosecutor’s office in combating corruption in Ukraine. It is emphasized that the activities of the prosecutor’s office agencies in general and in terms of combating corruption in Ukraine are settled by a large number of regulations. However, considering the urgency of this issue for the society and the importance for the state we can only talk about the beginning of work in this direction. It is emphasized that overcoming of these problems depends not only on the perfection of the legal base, but, primarily is due to the human factor. Therefore, special attention should be paid not only to the study of the mechanism of the functioning of the prosecutor’s office agencies, but also the mechanisms of personnel recruitment, their attestation, certification and provision to public open access to these processes.

Предпринята попытка проанализировать действующее законодательство, регулирующее деятельность органов прокуратуры по противодействию коррупции в Украине. Уделено внимание толкованию термина «нормативно-правовое регулирование» и отмечено, что его понимание в юридической литературе неоднозначно и спорно. Подчеркнуто, что в целях законодательного обеспечения деятельности органов прокуратуры разработан ряд нормативных актов, которые в той или иной степени регулируют деятельность данного органа, направленную на противодействие коррупции в Украине. Они отличаются друг от друга по многим признакам: юридической силой, названием, порядком принятия, порядком вступления в силу и действия и т. п. Особое внимание уделено влиянию международных правовых актов, ратифицированных в установленном порядке, на правовую основу деятельности прокуратуры по противодействию коррупции в Украине.
