Повноваження адвоката при здійсненні міжнародного співробітництва під час кримінального провадження

Abstract

Висвітлено повноваження адвоката при здійсненні міжнародного співробітництва під час кримінального провадження. Встановлено, що адвокат при наданні правової допомоги, виконанні функцій захисту і представництва, має повноваження діяти на будь-якій стадії кримінального провадження. Міжнародне співробітництво у кримінальному провадженні є його невід’ємною складовою і регламентується розділом ІХ КПК України.

The purpose of the scientific article is to highlight the powers of a lawyer in the implementation of international cooperation in criminal proceedings. The solution of the set goal and tasks took place under the condition of application of a number of methods of scientific cognition: general - dialectical method of scientific cognition, and also special - comparative-legal, historical-legal, system-structural, etc. It is established that a lawyer has the authority to act at any stage of criminal proceedings when providing legal assistance, performing the functions of protection and representation. International cooperation in criminal proceedings is an integral part of it and is regulated by Section IX of the CPC of Ukraine. The legislator has defined the following forms of international cooperation: international legal assistance in carrying out procedural actions (Chapter 43 of the CPC of Ukraine); extradition of persons who have committed a criminal offense (extradition) (Chapter 44 of the CPC of Ukraine); criminal proceedings by way of adoption (Chapter 45 of the CPC of Ukraine); recognition and execution of sentences of courts of foreign states and transfer of convicted persons (Chapter 46 of the CPC of Ukraine). In the implementation of all these forms of international cooperation in criminal proceedings, it is important to ensure the implementation of the lawyer’s powers under international and national law. In the implementation of international cooperation, the powers of a lawyer as a defender and as a representative have a number of features and can be divided into two groups: 1) general powers of a lawyer, which are integral to his legal status. Law of Ukraine “On Advocacy and Advocacy” of 2012; 2) special powers of a lawyer, which belong to him depending on the type of legal aid, the stage of criminal proceedings, the existence of special conditions (application of measures of international cooperation).

Освещены полномочия адвоката при осуществлении международного сотрудничества в ходе уголовного производства. Установлено, что адвокат при оказании правовой помощи, выполнении функций защиты и представительства имеет полномочия действовать на любой стадии уголовного производства. Международное сотрудничество в уголовном производстве является его неотъемлемой составляющей и регламентируется разделом IX УПК Украины.
