Зарубіжний досвід правового регулювання реалізації права на працю суддями

Abstract

Узагальнено позитивний зарубіжний досвід правового регулювання реалізації права на працю суддями на прикладі таких країн як: Сполучені Штати Америки, Франція та Республіка Казахстан. Окреслено ключові особливості та відмінності правового регулювання трудових прав суддів в межах кожної держави. Акцентовано увагу на специфіці та можливості перейняття найбільш позитивного зарубіжного досвіду правового регулювання реалізації права на працю суддями у вітчизняних реаліях. Наголошено, що в різних державах існують досить різноманітні та специфічні підходи до регулювання праці суддів. В більшості випадків специфіка забезпечення права на працю цієї категорії працівників, зокрема, в контексті доступу до професії, набору трудових прав та свобод, системи оплати труда та інші суміжні питання, прямо залежать від системи судоустрою країни. Чим більш «федеративнішою» є країна, тим значно розгалуженішим видається система правового регулювання праці суддів взагалі та працівників суду, зокрема.

The relevance of the article lies in the fact that the European integration policy of our country in the 21st century largely determined the main directions of development of the political, economic, social and legal spheres, which provided for the use and approval of international standards on certain issues of the internal life of the country and the population. The culmination and greatest achievement of the integration policy was the adoption of the Association Agreement with the European Union, which confirmed the rapprochement of our state with the international community. One of the key issues raised in the agreement, as the goal of reforming on the basis of world standards, was the activity of judicial bodies. The article, based on the analysis of scientific views of scientists, summarizes the positive foreign experience of legal regulation of the exercise of the right to work by judges on the example of such countries as: the United States of America, France and the Republic of Kazakhstan. The key features and differences of the legal regulation of the labor rights of judges within each state are outlined. Attention is focused on the specifics and the possibility of adopting the most positive foreign experience of legal regulation of the implementation of the right to work by judges in domestic realities. It was concluded that there are quite diverse and specific approaches to regulating the work of judges in different states. In most cases, the specifics of ensuring the right to work for this category of workers, in particular, in the context of access to the profession, the set of labor rights and freedoms, the wage system and other related issues, directly depend on the country's judicial system. The more "federal" a country is, the more extensive the system of legal regulation of the work of judges in general and court employees in particular appears to be. It is worth remembering that Ukraine is an independent and fully formed state with its own legal system, which may be similar in certain features to foreign legal systems, but not identical. Because of this, the adoption of foreign experience in matters of legal regulation of the exercise of the right to the work of judges cannot be based on any one example, which in Ukrainian realities will become not only useless, but even negative. Among the positive experiences that should be used by the domestic legislator are: firstly, the expansion of the system of guarantees for the exercise of the right to work by judges; secondly, improvement of the legal system, the norms of which regulate issues related to the performance of work by judges; thirdly, it is advisable to review the system of selection and promotion of judges.

Обобщен положительный зарубежный опыт правового регулирования реализации права на труд судьями на примере таких стран как Соединенные Штаты Америки, Франция и Республика Казахстан. Определены ключевые особенности и отличия правового регулирования трудовых прав судей в пределах каждого государства. Акцентировано внимание на специфике и возможности перенять наиболее положительный зарубежный опыт правового регулирования реализации права на труд судьями в отечественных реалиях. Отмечено, что в разных государствах существуют достаточно разные и специфические подходы к регулированию труда судей. В большинстве случаев специфика обеспечения права на труд этой категории работников, в частности, в контексте доступа к профессии, набору трудовых прав и свобод, системы оплаты труда и другие смежные вопросы напрямую зависят от системы судоустройства страны. Чем «федеративнее» страна, тем более разветвленной представляется система правового регулирования труда судей вообще и работников суда, в частности.
