Анотація
Досліджено можливі прояви корупції у сфері надання адміністративних послуг. Визначено основні корупційні ризики та виокремлено їх головні ознаки. Розглянуто шляхи удосконалення процесу надання адміністративних послуг для більш ефективного та надійного захисту прав і свобод громадян від протиправних рішень посадових осіб органів державної влади. Наголошено, що оптимізація процесу надання адміністративних послуг спрямована на забезпечення законності, справедливості, доцільності та ефективності адміністративного регулювання, а основна її мета – забезпечення максимального захисту від можливих корупційних проявів.
The author researches the possible corruption manifestations in the sphere of providing administrative services. The objective of the research is a complete and comprehensive analysis of the mechanism of providing administrative services and corruption risks in this area. The main corruption risks are determined and their main characteristics are singled out. The ways to improve the process of providing administrative services for more efficient and reliable protection of citizens’ rights and freedoms against unlawful decisions of officials working at the state power bodies are considered in the article. The following corruption manifestations in the sphere of providing administrative services are defined. They include: unreasonably long terms of providing certain administrative services; limited access to the administrative body that provides administrative services; complexity of the procedure of providing many administrative services; limited possibilities of a person in choosing the way of addressing for an administrative service; lack of information about the procedure of providing administrative services; irregularity of payment for administrative services; additional paid services, etc. The author formulates the main problematic aspects in the sphere of providing administrative services, which include: continuous updating of the list of paid services; creation of monopolistic intermediaries; inadequate legal regulation of the procedure of providing services; absence of criteria for dividing services into free and paid; inconvenient schedule for providing services; incomplete access to information that is needed for receiving services; uncertain term of providing some services. It is emphasized that the optimization of the process of providing administrative services is aimed at ensuring the legality, fairness, appropriateness and effectiveness of administrative regulation and the main objective is to ensure the maximum protection against possible corruption manifestations.
Исследованы возможные проявления коррупции в сфере предоставления административных услуг. Определены главные коррупционные риски и выделены их основные признаки. Рассмотрены пути совершенствования процесса предоставления административных услуг для более эффективной и надёжной защиты прав и свобод граждан от противоправных решений должностных лиц органов государственной власти. Отмечено, что оптимизация процесса предоставления административных услуг направлена на обеспечение законности, справедливости, целесообразности и эффективности административного регулирования, а основная её цель – обеспечение максимальной защиты от возможных коррупционных проявлений.
