Адміністративно-правове регулювання обігу зброї в Республіці Білорусь

Abstract

Проаналізовано нормативно-правові акти, які регулюють ліцензійно-дозвільну систему в Республіці Білорусь. Визначено, що ліцензійно-дозвільна система являє собою законодавчо закріплений порядок, що пропонує обов’язковість отримання юридичними та фізичними особами дозволу від уповноважених державних органів і організацій на вчинення певних дій, а також отримання певних повноважень. Установлено порядок обігу зброї і боєприпасів у Республіці Білорусь.This article analyzes regulations, that govern the licensing system in the Belarus Republic. It is determined that the licensing system is a legally established procedure that provides binding of obtaining by legal and natural persons a permission from the authorized state bodies and organizations to perform certain actions and obtain certain powers. A procedure of combat trafficking of arms and ammunition in Belarus is established. One of the main pieces of legislation, governing the terms of the license-permit system in the Belarus Republic, is a law of the Belarus Republic «On Weapon». Under the current licensing regulations licensing system applies the following objects: weapon of war of any kind and ammunition; hunting and sport (firing and pneumatic) weapons and ammunition; edged weapons, including hunting knives; special devices and accessories intended for body injury or chilling effect; aerosol packaging with gas irritant, nervous-paralytic, and toxic action; gas guns and ammunition; firearms simulators, that operate using blank ammunition; explosives and explosive devices; potent, toxic drugs and radioactive substances; seals and stamps; armed-fireworks and repair shops; enterprise for the production of cold steel; shooting galleries and shooting; stores of the arms trade; other objects uncontrolled use or operation of which may harm the interests of the state and the security of citizens. Depending on the functional purpose there are the following weapons: cold; throwing; air guns; sports; hunting; gas; signal. The weapon is classified by its purpose for use by the relevant entities, and the main options and characteristics of the following types: military, official and civil.Проанализированы нормативно-правовые акты, регулирующие лицензионно-разрешительную систему в Республике Беларусь. Определено, что лицензионно-разрешительная система представляет собой законодательно закрепленный порядок, пред- полагает обязательное получение юридическими и физическими лицами разрешения от уполномоченных государственных органов и организаций на совершение определенных действий, а также получение определенных полномочий. Установлен порядок оборота оружия и боеприпасов в Республике Беларусь.
