Анотація
Порушено питання про відсутність нормативно визначеного поняття адміністративної відповідальності. Детально розглянуто основні підходи представників адміністративноправової науки до визначення поняття адміністративної відповідальності. Визначено та
проаналізовано основні риси адміністративної відповідальності, внаслідок чого сформульовано узагальнююче поняття зазначеної дефініції як складного багатогранного явища.
The article is devoted to the research of the concept and features of administrative liability, considering the absence of the defined notion of the latter in the legislation. The objective of this article is to determine the summarizing concept of the administrative liability, which would make possible to eliminate shortcomings of the existing positions of scholars on this issue and could find its consolidation in long-term administrative and tortuous legislation. To achieve the objective the author studies in detail the main approaches of administrative and legal science’s representatives concerning the definition of the administrative liability, namely the concept of «sanction» administrative liability; understanding of the administrative liability as an element of the administrative compulsion; certain type (class) of legal relations arising between the state and entities of administrative offenses; one of the types of legal liability. Analysis of stated views indicates that the existence of any approach for determining the administrative liability provides an opportunity to highlight one or another of its properties, which in turn does not deny any of the concepts of the administrative liability. As a result the author defines and analyzes the main features of the administrative liability, formulates summarizing concept of stated definition as a complex multifaceted phenomenon. Offered by the author concept of the administrative liability includes all elements of this category that allows to eliminate the debates on the theoretical level according its determination and may find its reflection in the long-term administrative and tortuous legislation.
Поднят вопрос об отсутствии нормативно установленного понятия административной ответственности. Детально рассмотрены основные подходы представителей административно-правовой науки к определению понятия административной ответственности. Определены и проанализированы основные черты административной ответственности, в результате чего сформулировано обобщающее понятие указанной дефиниции как сложного многогранного явления.
