Особливості проведення слідчого експерименту під час розслідування корупційних злочинів у сфері службової діяльності та професійної діяльності, пов’язаної з наданням публічних послуг

Abstract

Проаналізовано особливості слідчого експерименту під час розслідування корупційних злочинів у сфері службової діяльності та професійної діяльності, пов’язаної з наданням публічних послуг. Зазначено, що слідчий експеримент – це слідча (розшукова) дія, яка провадиться шляхом відтворення дій, обстановки та обставин події і виконанням дослідів і випробувань, внаслідок чого можуть бути перевірені, уточнені та здобуті нові докази. Підкреслено, що у кримінальному провадженні корупційних злочинів у сфері службової діяльності та професійної діяльності, пов’язаної з наданням публічних послуг, слідчий експеримент проводиться у формі дослідів, а також відтворення дій, обстановки та обставин події, а також перевірки показань із підозрюваним і свідками злочину.

Проанализированы особенности следственного эксперимента при расследовании коррупционных преступлений в сфере служебной деятельности и профессиональной деятельности, связанной с предоставлением публичных услуг. Отмечено, что следственный эксперимент – это следственное (розыскное) действие, производимое путем воспроизведения действий, обстановки и обстоятельств происшествия и выполнением опытов и испытаний, в результате чего могут быть проверены, уточнены и получены новые доказательства. Подчеркнуто, что в уголовном производстве коррупционных преступлений в сфере служебной деятельности и профессиональной деятельности, связанной с предоставлением публичных услуг, следственный эксперимент проводится в форме опытов, а также воспроизводство действий, обстановки и обстоятельств происшествия, а также проверки показаний с подозреваемым и свидетелями преступления.
