Ґенеза правового регулювання захисту прав працівників від незаконного звільнення

Abstract

Проаналізовано ґенезу правового регулювання захисту прав працівників від незаконного звільнення. Запропоновано періодизацію розвитку правового регулювання механізму захисту прав працівників в контексті припинення трудових відносин. Оцінено стан правового регулювання захисту трудових прав від незаконного звільнення на кожному історичному етапі. Розглянуто поточний стан розвитку правового регулювання даної категорії в сучасній Україні.

The purpose of the article is to analyze the genesis of the legal regulation of the protection of the rights of employees against illegal dismissal. Achieving the set goal determines the need to solve the following tasks: 1) propose the periodization of the development of the legal regulation of the mechanism for protecting the rights of employees in the context of the termination of labor relations; 2) assess the state of legal regulation of the protection of labor rights against illegal dismissal at each historical stage; 3) draw a conclusion about the current state of development of legal regulation of this category in modern Ukraine. A scientific position has been formulated regarding the periodization of the genesis of the development of legal regulation of the protection of the rights of employees against illegal dismissal. Each historical segment of the development of the legal basis for the protection of labor rights of employees in the context of the termination of employment relations is analyzed. The current state and prospects of the further evolution of the system of legal regulation of the mechanism of protection of labor rights against illegal dismissal have been established. It was concluded that despite the fact that since the 90s of the 20th century, the legal system of Ukraine embarked on an independent path of development, for the first time in history, taking into account only the interests of its own population and domestic political and economic realities, in the matter of labor regulation and labor relations, radical changes and reforms have not yet been carried out. Confirmation of this fact is the validity of the Code of Labor Laws of Ukraine dated 10.12.1971, which was adopted during the Soviet era, and a modern regulatory and legal document that would meet not only modern challenges in the field of work, but also the new socio-economic system of our country. And so, in conclusion, we can state that the genesis of the legal regulation of the protection of the rights of employees against illegal dismissal is currently ongoing and is in an active phase. The goal of such reform should be, first of all, a departure from the Soviet model of labor regulation and a transition to the leading European and world standards in the field of protection of the legal rights, freedoms and interests of employees, including against illegal dismissal

Проанализирован генезис правового регулирования защиты прав работников от незаконного увольнения. Предложена периодизация развития правового регулирования механизма защиты прав работников в контексте прекращения трудовых отношений. Оценено состояние правового регулирования защиты трудовых прав от незаконного увольнения на каждом историческом этапе. Рассмотрено текущее состояние развития правового регулирования данной категории в Украине.
