Верховна Рада України як суб’єкт дигіталізації державної влади

Abstract

У статті доводиться, що дигіталізація органів державної влади в Україні є, безумовно, надскладним управлінським процесом і, разом з тим, актуальним суспільно-політичним і правовим завданням, масштаби якого вражають і змушують ретельно зважувати і прораховувати всі можливі управлінські ризики і проблеми. Вказується, що саме парламент унаслідок свого унікального статусу як єдиного органу законодавчої влади та специфіки своєї правотворчої компетенції формулює базові правові засади дигіталізації системи органів державної влади, спрямовуючи нормотворчу діяльність інших органів на виконання відповідних законів. Далі наводяться приклади реалізації компетенції Верховної Ради України в галузі дигіталізації системи органів державної влади, аналізується низка ключових законів для дигіталізації як усієї системи органів державної влади, так і окремих її підсистем (законодавчої, виконавчої чи судової влад). Констатується, що суб’єктність Верховної Ради України у сфері дигіталізації системи органів державної влади в Україні протягом останніх двох скликань парламенту (восьмого (2014- 2019 роки) та дев’ятого (2019 рік – досі) скликань) помітно зросла. Констатується, що окремим суб’єктом у структурі законодавчої влади, що впливає на дигіталізацію всієї системи органів державної влади, слід визнати у структурі Верховної Ради України Комітет з питань цифрової трансформації. Самостійним суб’єктом дигіталізації державної влади в системі законодавчої влади виступає Голова Верховної Ради України, обсяг повноважень якого в силу його функціональної ролі, природно, обмежений внутрішньо-парламентськими процесами, тобто окремими (переважно організаційними та розпорядчими) питаннями дигіталізації єдиного органу законодавчої влади України та її Апарату.The article argues that the digitalization of state authorities in Ukraine is, without a doubt, an extremely complex management process and, at the same time, an urgent sociopolitical and legal task. Its scale is impressive and requires careful consideration and calculation of all possible management risks and issues. It is noted that the parliament, due to its unique status as the sole legislative body and the specificity of its legislative competence, formulates the basic legal principles of digitalization for the system of state authorities, guiding the legislative activities of other bodies to implement relevant laws. The article further provides examples of the Verkhovna Rada of Ukraine’s competence in digitalizing the state authority system, analyzing several key laws for digitalization of both the entire system of state authorities and its individual subsystems (legislative, executive, or judicial branches). It is stated that the subjectivity of the Verkhovna Rada of Ukraine in the sphere of digitalization of the state authority system in Ukraine has noticeably increased over the past two parliamentary convocations (the eighth (2014-2019) and the ninth (2019 to present)). It is also noted that a distinct entity within the legislative branch that influences the digitalization of the entire state authority system should be recognized within the structure of the Verkhovna Rada of Ukraine — the Committee on Digital Transformation. An independent subject of state authority digitalization within the legislative branch is the Chairman of the Verkhovna Rada of Ukraine, whose powers, by virtue of his functional role, are naturally limited to intraparliamentary processes, i.e., specific (mainly organizational and administrative) issues of digitalization of the sole legislative body of Ukraine and its Secretariat.Выяснены особенности Верховной Рады Украины как субъекта дигитализации государственной власти.
