Предмет договору контрактації сільськогосподарської продукції

Abstract

У статті проаналізовано співвідношення предмету та об’єкта договору. Порівнюються доктринальні погляди на об’єкт та предмет договору контрактації сільськогосподарської продукції. Визначається, що предметом договору контрактації є дії зобов’язаних осіб, а об’єктом може бути сільськогосподарська продукція, як у сирому вигляді, так і така, що пройшла первинну обробку. Аналізується визначення сільськогосподарської продукції та наводиться її перелік.

Problem Setting. In order to regulate relations in the feld of the purchase of agricultural products from producers, the parties conclude a contract for the delivery of agricultural products. Therefore the subject matter of the contract for the delivery of agricultural products should be clearly defned and differentiated from the object. Target of the paper is to investigate the subject matter of the contract for the delivery of agricultural products. In order to achieve this goal, the following tasks must be solved: 1) to analyse correlation between the subject matter and the object of the contract; 2) to compare the doctrinal views on the subject matter and the object of the contract for the delivery of agricultural products; 3) to carry out an analysis of the defnitions of agricultural products and provide their list. Analysis of resent researches and publications. The problem of defning the subject matter of the contract has been investigated by legal scholars in different respects. Comprehensive research in this sphere was conducted by M.M. Agarkov, M.I.Braginskyi, V.V.Vitrianskyi, N.S. Kuznietsova, O.V.Dzera, V.V.Luts and others. Article’s main body. The article analyzes correlation between the subject matter and the object of the contract. The doctrinal views on the subject matter and the object of the contract for the delivery of agricultural products are compared. The subject matter of the contract for the delivery of agricultural products is defned as actions of obligated persons, and the object as agricultural products, both in raw form and the ones that have undergone initial processing. The defnitions of agricultural products are analysed and their list is provided. Conclusions and prospects for the development. Consequently, the study of the subject matter of the contract for the delivery of agricultural products is important for scientifc and practical purposes, since the lack of provisions in the legislation prevents the proper protection of the rights of the parties.

В статье осуществляется анализ соотношения предмета и объекта договора. Проведено сравнение доктринальных взглядов на объект и предмет договора контрактации сельскохозяйственной продукции. Определяется, что предметом договора контрактации есть действия обязанных лиц, а объектом может быть сельскохозяйственная продукция, как в сыром виде, так и такая, что прошла первичную обработку. Анализируется определение сельскохозяйственной продукции и дается ее перечень.
