dc.description.abstractНа підставі аналізу наукових точок зору та відповідних нормативно-правових актів розроблено авторське бачення співвідношення понять «принципи» та «гарантії» незалежності прокуратури в Україні. Встановлено, що реалізація принципу незалежності органів прокуратури здійснюється безпосередньо через певні конкретні процедури, які викладені у конкретній формі (наприклад, через процедуру призначення конкретної особи на посаду).
dc.description.abstractThe objective of the article is clarification of the essence of independence of the prosecutor’s office, features of guarantees of independence of the prosecutor’s office and disclosure of correlation between «principles» and «guarantees» of independence of the prosecutor’s office of Ukraine. The article is devoted to the research of correlation between «principles» and «guarantees» of independence of the prosecutor’s office in Ukraine. On the basis of scientific points of view and relevant legal acts’ analysis the author has developed her own vision of correlation between «principles» and «guarantees» of independence of the prosecutor’s office in Ukraine. The main features of guarantees of independence of the prosecutor’s office in Ukraine are determined. It is established that realization of the principle of independence of the prosecutor’s office is made directly through certain specific procedures set out in a concrete form (for example, the procedure of appointment of a particular person on a position). It is grounded that the “principles” and «guarantees» of independence of the prosecutor’s office exist in a logical unity. However, realization guarantees of independence of the prosecutor’s office is an independent category, which can not be identified either with the actual principle of independence of the prosecutor’s office or with a prosecutor’s authorities, which must reinforce the effective functioning of the guarantee of this principle’s realization. The practical significance of the paper is the fact that considering formulated theoretical positions it is possible to develop specific recommendations concerning the improvement of the current legislation, which, in case of their implementation, allow raising the effectiveness of the mechanism of using the principle of independence of the prosecutor’s office of Ukraine.
dc.description.abstractНа основании анализа научных точек зрения и соответствующих нормативно-правовых актов разработано авторское виденье соотношения понятий «принципы» и «гарантии» независимости прокуратуры в Украине. Установлено, что реализация принципа независимости органов прокуратуры осуществляется непосредственно через определенные конкретные процедуры, которые изложены в конкретной форме (например, через процедуру назначения конкретного лица на должность).
