Анотація
У статті, спираючись на аналіз наукових поглядів вчених, надано характеристику системі правових засад забезпечення дисципліни та законності в Державному бюро розслідувань. Наголошено, що система відповідних засад представлена великою кількістю нормативних документів різної юридичної сили. Доведено, що в системі відповідних засад ключове місце відводиться нормам адміністративної галузі права.
It was noted that the administrative-legal regulation of ensuring discipline and legality in the State Bureau of Investigation is a regulatory and structuring infl uence on public relations of a publicmanagement nature, carried out with the help of norms of the administrative branch of law, which arise in the process of implementing measures and mechanisms aimed at creating legal and organizational conditions under which the offi cial activities of the DBR offi cials will be carried out in strict accordance with the specifi ed requirements, norms, rules and standards. It was emphasized that the legal principles of ensuring discipline and legality in the State Bureau of Investigation include the norms of constitutional, criminal procedural, labor and administrative law at the same time. However, the legal provisions of the fi rst branches of law mainly establish only the general principles of the legal status of the SBI, establishing the principles of its activity as a body of state power; peculiarities of work in the criminal-procedural direction, as a subject of criminal proceedings; the basics of ensuring the labor rights of personnel; etc. It was established that in the system of legal principles for ensuring discipline and legality in the State Bureau of Investigations, the key place is given to the norms of the administrative branch of law, because it is with the help of the norms of the latter: first, the general principles of the functioning of the State Bureau of Investigations are determined, in particular, its legal status, structure, system management, etc.; secondly, the key powers (a set of rights and responsibilities) of the management and rank-and-file employees of the SBI are fi xed; thirdly, the tasks, functions, competence of the heads of the State Bureau of Investigation are established; fourthly, the forms, methods, and limits within which the heads of the Bureau can carry out activities are determined; fifth, the limits of the legal responsibility of managers as subjects of ensuring discipline and legality in the functioning of the department are outlined.
В статье, опираясь на анализ научных взглядов ученых, предоставлена характеристика системы правовых основ обеспечения дисциплины и законности в Государственном бюро расследований. Отмечено, что система соответствующих основ представлена большим количеством нормативных документов разной юридической силы. Доказано, что в системе соответствующих принципов ключевое место отводится нормам административной отрасли права.
