dc.description.abstractThe features of accounting socially dangerous consequences of crimes with the formal corpus delicti are analyzed. It is alleged that the crimes that fall under the features of the so-called «formal» corpus delicti, are irrefutably presumed in all cases as those that cause harm to public relations protected by criminal law. It is noted that the socially dangerous consequences have the following features: in some cases the consequences are included into the disposition of the article of the Special Section of the Criminal Code as a mandatory feature of the corpus delicti, in others are not included. Depending on this all crimes are divided into two groups: 1) crimes with the material corpus delicti; 2) crimes with a formal corpus delicti. The structure of the formal corpus delicti is such that their consequences are beyond the required attributes of the objective side. That is why the subject can not wish for their occurrence. However, this fact does not exclude the intentional guilt. Intelligent feature of the intent in these cases contains only awareness by the subject of socially dangerous nature of the committed by him act, there is not any relation to consequences and can not occur. Forceful feature of the intention is limited to the desire to commit a certain act or omission. It is noted that under the investigation and trial of criminal cases involving crimes with the formal corpus delicti the consequences are not proved, but presumed. It is enough to detect socially dangerous act specified in the criminal law. In such cases, the consequences of a crime are not reflected in the charge formula. The presumption is not applied to all crimes with a formal corpus delicti. So, it is not applied in cases, where the main corpus delicti is formal and qualified as an essential feature of the objective side presumes material or physical harm.en
