Особливості здійснення тимчасового доступу до електронних інформаційних систем або їх частин, мобільних терміналів систем зв'язку

Abstract

У статті досліджено питання здійснення тимчасового доступу до електронних інформаційних систем або їх частин, мобільних терміналів систем зв'язку. Зазначено, що особливістю здійснення цього різновиду тимчасового доступу є зняття лише копії інформації без її вилучення. Сформовано окремі пропозиції та запропоновано рекомендації щодо правозастосування інституту тимчасового доступу до речей і документів.

The article explores some issues of temporary access to electronic information systems or their parts, mobile terminais of communication systems. The legislative concept of temporary access to things and documents is given, its purpose and ways of conducting are reflected. It is noted that the feature of the implementation of this type of temporary access is the removal of only a copy of the information without extracting it. Special attention is drawn to the fact that the current Criminal Procedure Code of Ukraine does not contain special requirements for drawing up a description, except for indicating the list of seized items. Description, as a document, must be formalized in accordance with the general requirements for a paper document. In this case, the purpose of the description is to fix the conduct of procedural action in criminal proceedings. Attention is drawn to the expediency of drawing up a protocol for temporary access to things and documents, which is not inconsistent and is consistent with the probation of Article 104 of the Criminal Procedure Code of Ukraine. Attention is drawn to the fact that the investigator has no right to entrust execution of the decision of the investigating judge, the court on temporary access to things and documents to employees of operational units. This is explained by the fact that according to point 3 of part 2 of Art. 40 of the Criminal Procedure Code of Ukraine, the investigator is authorized to entrust investigative (search) actions and secret investigative (search) actions to the relevant operational units. Some proposals and recommendations on the law enforcement of the institution of temporary access to things and documents have been formed.

В статье исследованы отдельные вопросы осуществления временного доступа к электронным информационным системам или их частей, мобильных терминалов систем связи. Приведено законодательное понятие временного доступа к вещам и документам, отображена его цель и способы проведения. Отмечено, что особенностью осуществления данного вида временного доступа является снятие только копии информации без ее извлечения. Сформированы отдельные предложения и рекомендации по правоприменению института временного доступа к вещам и документам.
