Abstract

Проаналізовано адміністративно-правовий статус Кваліфікаційно-дисциплінарної комісії адвокатури. Досліджено функції, повноваження та діяльність цієї комісії з метою визначення її ролі в регулюванні адвокатської діяльності в Україні. Розглянуто питання щодо незалежності Кваліфікаційно-дисциплінарної комісії та її здатності забезпечувати об’єктивний та справедливий розгляд справ. Надано порівняння практики та стандартів щодо адміністративно-правового статусу подібних комісій у різних країнах з метою ідентифікації найкращих практик та можливих напрямків реформування системи регулювання адвокатської діяльності в Україні.The purpose of the article is to review and analyze the administrative and legal status of the Qualification and Disciplinary Commission of the Bar. The article will conduct research on the functions, powers and activities of this commission in order to determine its role in the regulation of advocacy in Ukraine. The purpose of the article also includes a comparison of practices and standards regarding the administrative-legal status of similar commissions in different countries with the aim of identifying best practices and possible directions for reforming the system of legal regulation of advocacy. The article analyzes the legislative and regulatory acts that determine the functions and powers of the Qualification and Disciplinary Commission, as well as compares this status with international standards and practices of other countries. A comparative analysis of the administrative-legal status of the Qualification and Disciplinary Commission of the Bar in Ukraine with the practice and standards existing in other countries or at the international level makes it possible to determine the extent to which Ukraine complies with international norms and practice in the regulation of advocacy. It was determined that the independence of the Qualification and Disciplinary Commission from external influences is legally guaranteed. This helps ensure the objective consideration of lawyers’ cases and compliance with the principles of justice and professional ethics in the legal profession. Key conclusions and recommendations are formulated on the basis of the conducted analysis. Among them, the following are important: ensuring the independence of the Qualification and Disciplinary Commission from external influences, which is important for ensuring objectivity when considering disciplinary cases; ensuring transparency and the possibility of public control over the decisions of the Qualification and Disciplinary Commission; improving the procedures for consideration of disciplinary cases and ensuring access to fair and effective judicial control; cooperation with international advocacy organizations and consideration of international standards; involvement of the public and professional bar associations in the process of control and supervision over the activities of the Qualification and Disciplinary Commission; constant monitoring and updating of legislation to meet modern requirements.Проанализирован административно-правовой статус Квалификационно-дисциплинарной комиссии адвокатуры. Исследованы функции, полномочия и деятельность этой комиссии с целью определения ее роли в регулировании адвокатской деятельности в Украине. Рассмотрены вопросы независимости Квалификационно-дисциплинарной комиссии и ее способности обеспечивать объективное и справедливое рассмотрение дел. Даны сравнительные характеристики практики и стандартов по административно-правовому статусу подобных комиссий в разных странах с целью идентификации лучших практик и возможных направлений реформирования системы регулирования адвокатской деятельности в Украине.
