Анотація
Зазначено, що сучасне правове регулювання прав інтелектуальної власності однією зі своїх засад має баланс публічних та приватних інтересів. Однак сучасний розвиток суспільних
відносин та світові тенденції приводять до зміни точки цього балансу. Основними факторами, які здійснюють зазначений вплив, є глобалізація та науково-технічний прогрес. Баланс змінюється на користь публічних інтересів, хоча при цьому в центрі уваги та піклування залишаються права та інтереси людини.
Intellectual property law is the basis of the functioning of the innovation market in the country and in the world and, in this sense, is one of the first places in the lens of the state. Innovation is the engine of the economy, and the products of intellectual creativity are the engine of progress, economic and cultural growth. Today we should note the tendency to shift the fundamental principles of regulation of innovation and relations in the field of intellectual property law, due to general trends in the world. Modern legal regulation of intellectual property rights is one of its principles has a balance of public and private interests. However, the current development of social relations and global trends are changing the point of this balance. The main factors contributing to this impact are globalization and scientific and technological progress. The balance shifts in the public interest, although human rights and interests remain at the center of attention and care. The main aspects of the impact of globalization on intellectual property rights are as follows: 1) globalization as a reason for unification and harmonization of legislation of the region and the world; 2) globalization as a prerequisite for expanding cross-border legal regulation; 3) creation of new legal regimes in the existing mechanisms of legal regulation on the call of globalization. As for another trend of the modern world, which is directly related to the field of intellectual property – is the constant acceleration of scientific and technological progress and, consequently, the modernization of all spheres of public life. The Internet is perhaps the most global phenomenon in the modern world, which has led to significant changes, including in the legal field. This effect is manifested in the emergence of new rights due to the emergence of new technologies and opportunities, the expansion of existing rights, the requirements of new formats of the legal relations and their characteristics. The Ukrainian model of regulating in the digital environment should take into account Ukraine’s European integration progress, but realizing that the Internet is becoming a separate information add-on.

Однако современное развитие общественных отношений и мировые тенденции приводят к изменению точки этого баланса.
