Типові слідчі ситуації початкового етапу розслідування викрадень бюджетних коштів в агропромисловому комплексі

Abstract

З урахуванням криміналістичних особливостей злочинів, пов’язаних з використанням бюджетних коштів в агропромисловому комплексі, виділено типові слідчі ситуації початкового етапу їх розслідування. Висвітлено зміст поняття типової слідчої ситуації, наведено основні тактичні завдання розслідування щодо кожної ситуації.

With the adoption of the new Criminal Procedural Code of Ukraine activity of the pre-trial investigation agencies, including divisions of internal affairs agencies in the whole aimed at the direct detection and investigation of criminal offenses has changed. This is due to the amendment to the semantic content of certain categories, like conducting investigative (search) and other actions, setting examinations, involving experts and specialists; enlarging the duties of the participants of criminal proceedings; partially modification of the measures of guaranteeing criminal proceedings, etc. These circumstances demand a new coordination of realizing the procedure of criminal proceedings and correspondently the need to increase such a scientific category as forensic method. An important element for forming the effective method of investigating certain types of crimes is investigative situations and the corresponding algorithm of actions. Choosing the correct sequence of any procedural, investigative (search) and secret investigative (search) actions while detecting any crime, will help to reduce statistics about violation of procedural terms of investigation set by the legislation. That is the key of fast, efficient, complete, effective and impartial investigation. Crimes involving the use of budget resources within agro-industrial complex are not exception. Taking into consideration the above stated and forensic features of such criminal offences the author distinguished typical investigative situations at initial stages of their investigation. Content of the notion «typical investigative situation» is elucidated; the basic tactical tasks of investigating each situation are presented.

С учетом криминалистических особенностей преступлений, связанных с использованием бюджетных средств в агропромышленном комплексе, выделены типичные следственные ситуации первоначального этапа их расследования. Освещено содержание понятия типичной следственной ситуации, приведены основные тактические задачи расследования по каждой ситуации.
