Анотація
У статті подано психолого-правовий аналіз проблеми вини, розглянуто
основні сучасні теорії вини, у тому числі – кримінально-правові та психологічні.
Показано, що емоція вини стимулює розумові процеси, які пов’язані з
усвідомленням вини особою та з вибором можливостей для виправлення певної
ситуації. Установлено причинно-наслідковий зв’язок між явищами свідомовольової поведінки, повного усвідомлення фактичного характеру своїх дій
(бездіяльності) та керування ними, осудності (неосудності) особи. Визначено
психологічну структуру усвідомлення вини неповнолітніми злочинцями, виділено
її когнітивний, емоційний та поведінковий компоненти.
The article presents a legal-psychological analysis of the problem of guilt considers the main modern theories of guilt, including criminal-legal and psychological. It is shown that the emotion of guilt stimulates mental processes that are related to the person’s awareness of guilt and the choice of opportunities to correct a certain situation. A cause-and-effect relationship between the phenomena of conscious-volitional behavior, full awareness of the actual nature of one’s actions (inaction) and their management, and sanity (insanity) of a person has been established. The psychological structure of the awareness of guilt by juvenile criminals is defined, its cognitive, emotional and behavioral components are highlighted. The study of the psychological factors of the awareness of by juvenile criminals was conducted in two stages: at the first stage, the study of the peculiarities of the awareness of guilt by juvenile criminals was conducted; the task of the second stage was to determine the psychological factors affecting the level of awareness of guilt. Diagnostic methods and techniques that are relevant to the task of the monographic research and meet the requirements of reliability and validity are selected and described. It has been established that juvenile criminals experience guilt more quickly than they realize it, and the “serious” the crime committed, the higher the level of awareness of guilt. According to qualitative and quantitative characteristics, high, medium and low levels of awareness of guilt by juvenile criminals are distinguished. The scientist novelty of the study consists in distinguishing the types of juvenile criminals depending on the level and characteristics of their awareness of guilt. The practical significance of the study consists in justifying the need for individual and differentiated approaches to the resocialization of juvenile criminals during the period of adaptation to the colony, taking into account the level and characteristics of their awareness of guilt, as well as increasing the effectiveness of the educational process within penitentiary institutions. The material of the article is addressed to specialists of the penitentiary system, scientific and pedagogical workers, cadets and students of institutions of higher education of a legal profile, as well as scientific and practical workers in the field of legal and age psychology.
В статье представлен психолого-правовой анализ проблемы вины, рассмотрены основные современные теории вины, в том числе – уголовно-правовые и психологические. Показано, что эмоция вины стимулирует мыслительные процессы, связанные с осознанием вины лицом и с выбором возможностей для исправления определенной вины ситуации. Установлена причинно-следственная связь между явлениями сознательного поведения, полного осознания фактического характера своих действий (бездействия) и управление ими, вменяемости (невменяемости) личности. Определено психологическую структуру осознания вины несовершеннолетними преступниками, выделено ее когнитивный, эмоциональный и поведенческий компоненты.
