Сучасна система органів Національної поліції України та місце у ній Корпусу оперативно-раптової дії

Abstract

Досліджено сучасну систему органів Національної поліції, а також місце в ній Корпусу оперативно-раптової дії. Встановлено, що Корпус оперативно-раптової дії займає особливе положення в структурі Національної поліції України, є абсолютно новим підрозділом, що має на меті вирішення надзвичайних ситуацій, рівень яких надскладний та високий, та поєднав у собі функції існуючих раніше спеціальних підрозділів «Беркут», «Сокіл», «Грифон», «Титан» та інших. Акцентовано увагу на тому, що на новостворений Корпус оперативно-раптової дії покладені обов’язки, що потребують особливих знань, значного досвіду, відповідних якостей персоналу та чіткого чинного законодавства.

The article examines the modern system of bodies of the National Police, as well as the place in it of the Corps of Operative-Rapid Action. The emphasis is placed on the lack of a unifi ed approach of lawyers to the defi nition of the concept of the system within the scope of the issue under study. The components of the modern system of bodies of the National Police are determined and the characteristics, features, similar and distinctive features of each of them are specifi ed. It was established that the Operational and Action Action Corps occupies a special position within the structure of the National Police of Ukraine, is an entirely new subdivision aimed at solving emergency situations, the level of which is extremely complex and high, and combines the functions of the previously existing special units “Berkut”, “ Falcon “,” Griffi n “,” Titan “and others. The emphasis is placed on the fact that the newly created Corps of Operative-Rapid Action imposes obligations that require special knowledge, signifi cant experience, relevant personnel qualifi cations and clear current legislation. The theoretical and legal analysis of the existing legislative base on the existence and legal activity of the units of the National Police of Ukraine is conducted. Particular attention is paid to the unit of special purpose - the Corps of operative and sudden action - in the system of the National Police of Ukraine. It is determined, based on the current legislation, the National Police of Ukraine as an integral body of state power in the system of central bodies of executive power. The Operational and Action Action Corps is an independent unit of the Central Police Department and requires the regulation of its powers and functions at the legislative level. It is substantiated that the Operative-Rapid Action Corps, as a unit of the special purpose of the National Police of Ukraine, is the subject of ensuring public safety and order, which is in the process of its formation and active development.

Исследована современная система органов Национальной полиции, а также место в ней Корпуса оперативно-внезапного действия. Установлено, что Корпус оперативно-внезапного действия занимает особое положение в структуре Национальной полиции Украины, является абсолютно новым подразделением, имеющим целью решение чрезвычайных ситуаций, уровень которых сверхсложный и высокий, и объединил функции существующих ранее специальных подразделений «Беркут», « Сокол», «Грифон», «Титан» и другие. Акцентировано внимание на том, что на вновь созданный Корпус оперативно-внезапного действия возложены обязанности, требующие особых знаний, опыта, соответствующих качеств персонала и четкого действующего законодательства.
