dc.description.abstractУ статті, спираючись на аналіз наукових поглядів вчених, запропоновано авторське визначення поняття суб’єкту контролю та нагляду в сфері фізичної культури та спорту. Окреслено коло суб’єктів контролю в сфері фізичної культури та спорту України, а також притаманну їй ієрархічну модель побудови. Надано характеристику правовому статусу ключових суб’єктів нагляду і контролю у сфері фізичної культури та спорту.
dc.description.abstractIt was found that the subjects of control and supervision in the field of physical culture and sports are a system of state institutions, which, in accordance with the norms of the current legislation, are endowed with special powers (a set of subjective rights and legal obligations) regarding the implementation of control and supervision activities in the relevant field. Subjects of control include: 1) subjects of parliamentary control: the Verkhovna Rada of Ukraine, power institutions subordinate to it (committees of the Verkhovna Rada of Ukraine, the Human Rights Commissioner of the Verkhovna Rada of Ukraine); 2) bodies of executive power, as subjects of a separate type of control: the Cabinet of Ministers of Ukraine, the Ministry of Youth and Sports of Ukraine, local state administrations; 3) subjects of public control: public associations of physical culture and sports orientation, public councils under central and local bodies of executive power. The subjects of supervision in the field of physical culture and sports of Ukraine are: the supervisory board of the National Anti-Doping Control Laboratory, the National Agency for the Prevention of Corruption. It is noted that the powers of each of the subjects of control and supervision in the field of physical culture and sports outlined in the article are currently quite clearly defined in the Constitution, legislative and by-laws of our country, which highlight not only structural subordination, but also fully disclose the assigned they have administrative functions, rights and duties. At the same time, the fact that the powers of individual subjects sometimes duplicate each other was noted as a drawback. In addition, attention is focused on the fact that at the legislative level the issue of the interaction of the relevant subjects is actually not regulated, which significantly complicates law enforcement practice in the researched area.
dc.description.abstractВ статье, основываясь на анализе научных взглядов ученых, предложено авторское определение понятия субъекта контроля и надзора в сфере физической культуры и спорта. Обозначен круг субъектов контроля в сфере физической культуры и спорта Украины, а также присущую ей иерархическую модель построения. Дана характеристика правового статуса ключевых субъектов надзора и контроля в сфере физической культуры и спорта.
