Умови типового договору в цивільному праві

Abstract

Зазначено, що істотні умови договору визначають найсуттєвіші його аспекти, що випливають із правової природи відповідного договірного виду чи окремого договору. Істотні умови, що є універсальними чи характерними для договорів певного виду, як правило, визначаються законом. Наголошено, що типовим договорам має бути притаманна деяка охоронна функція, тобто вони завдяки державно встановленим приписам повинні слугувати охороні прав слабкої сторони договору.

The article states that the essential terms of the contract to determine the most essential aspects arising from the legal nature of the relevant type of contract or a separate agreement. The requirements that are universal or specific to a certain type of contracts are usually determined by law. Today the contract is not the main means of regulating social relations. Growth of the contract value as a source of modern civil law led to expand the scope of contractual regulation of social relations. The construction contracts into all spheres of economic and spiritual life of society. The role of the treaty as universal and most expediential mediation legal form of market relations increases significantly. It is noted that a model contract to be some inherent security feature, thanks to state that they must serve the requirements established protection of the rights of weak parties to the contract. It is claimed that such as model contracts for the provision of housing and communal services violate the principles of fairness and reasonableness. They should be identified by monitoring regulations and coordinate with law. Условия, которые являются универсальными или характерными для договоров определенного вида, как правило, определяются законом. Подчеркнуто, что типичные договоры должны обладать некоторой охранной функцией, то есть они благодаря государственно установленным предписаниям должны служить охране прав слабой стороны договора.
