dc.description.abstractДосліджено питання використання спеціальних знань спеціалістів різних галузей науки і техніки та судових експертів і тактичних питань використання результатів консультування спеціалістів та висновків експертних досліджень при доказуванні в кримінальних провадженнях з досліджених видів кримінальних правопорушень. Виокремлено особливості та кореляція між спеціальними знаннями спеціалістів і експертів різних направленостей при їх використанні в кримінальних провадженнях з розслідування фактів вбивств і причинення тяжких тілесних ушкоджень потерпілим особам. Окремо надано криміналістичну характеристику та специфіку використання спеціальних знань нововведених посад працівників спеціалістів-криміналістів у районних та інших підрозділах Національної поліції України. Напрацьовано конкретні тактичні і практичні рекомендації та пропозиції з питань особливостей застосування і використання спеціальних знань при досудовому розслідуванні вбивств та тяжких тілесних ушкоджень у правозастосовній діяльності та шляхи подальших наукових досліджень у цьому напрямі.
dc.description.abstractThe article retrospectively examines the issues of theoretical, legislative and other regulatory framework and specifi cs of law enforcement activities of pre-trial investigation bodies with regard to the peculiarities of using specialized knowledge from various branches of science and technology, in particular, investigation of murder and grievous bodily harm. It is established that there is an ongoing scientifi c debate on the essence of the concept of special knowledge and its use in the theory of criminalistics, forensic science and pre-trial investigation, in particular, investigation of murder and grievous bodily harm. During the study, the scientifi c positions of scientists and representatives of various scientifi c schools on the problematic and applied issues raised, and the author developed his own scientifi c positions on their solution, recommendations, and suggestions on how to implement them at the theoretical, legislative and applied levels. Separately and in comparison, the article examines the issues of using special knowledge of specialists in various fi elds of science and technology, forensic experts and tactical issues. Using the results of expert consulting and expert research fi ndings evidence in criminal proceedings on the types of criminal offences under study. The article identifi es the peculiarities and correlation between the special knowledge of specialists and experts of various fi elds when using it in criminal proceedings to investigate the facts of murder and infl iction of grievous bodily harm to victims. The article provides a separate forensic description and specifi cs of the use of special knowledge of the newly introduced positions of forensic specialists in district and other units of the National Police of Ukraine. Specifi c tactical and practical recommendations, suggestions on the specifi cs of application and use of special knowledge in the pre-trial investigation of murder and grievous bodily harm in law enforcement activities and ways of further research in this direction.
dc.description.abstractИсследованы вопросы использования специальных знаний специалистов разных отраслей науки и техники и судебных экспертов и тактических вопросов использование результатов консультирования специалистов и выводов экспертных исследований при доказывании в уголовных производствах по исследованным видам уголовных правонарушений. Отмечены особенности и корреляция между специальными знаниями специалистов и экспертов разных направленностей при их использовании в уголовных производствах по расследованию фактов убийств и причинению тяжких телесных повреждений.
