Порядок застосування дисциплінарних стягнень до працівників Національної поліції

Abstract

Визначено основні характеристики порядку застосування дисциплінарних стягнень до працівників поліції. Акцентовано увагу на процедурній різноманітності порядку застосування дисциплінарних стягнень до працівників Національної поліції. Констатовано центральне значення комісійного службового розслідування в контексті процедури притягнення працівників поліції до дисциплінарної відповідальності. Наголошено на окремих гарантіях прав поліцейських, які існують в процесі застосування до них дисциплінарних стягнень. Підкреслено позитивне значення існуючого порядку застосування дисциплінарних стягнень до працівників Національної поліції, який показує прагнення держави демократизувати даний процес, зробити його максимально об’єктивним та результативним, у першу чергу для працівника поліції.

The implementation of the functions and tasks assigned to public authorities, as a rule, occurs in compliance with the normatively defined sequence of actions, ie, in the appropriate manner or according to a certain procedure. Scientists are unanimous that the terms «order» and «procedure» are ambiguous and completely identical. In jurisprudence, the procedure determines the procedure for the subjects to perform certain legally significant actions, the totality of which forms the legal process. Emphasis is placed on the procedural diversity of the procedure for applying disciplinary sanctions to employees of the National Police. The central importance of the commission’s official investigation in the context of the procedure of bringing police officers to disciplinary responsibility was stated. Attention is drawn to certain guarantees of police rights that exist in the process of disciplinary action against them. The positive significance of the existing procedure for applying disciplinary sanctions to the National Police is determined, which shows the desire of the state to democratize this process, to make it as objective and effective as possible, especially for the police officer. The key points that should be noted in this context are: the definition, at the level of legislation, of the range of entities that have the right to apply or initiate the application of disciplinary sanctions against police officers; the importance of the role of the official investigation as a procedure for objectively establishing the facts and circumstances of a police officer’s disciplinary misconduct, as well as the general degree of his guilt; the existence of two forms of official investigation, one of which has the form of an open quasi-judicial process; the existence of a commission requirement for conducting official investigations, which involves investigating the facts and circumstances of a police officer’s disciplinary action by a commission consisting of various representatives of police bodies and units and in some cases may include members of the public; clear delineation of the forms of documents that should be drawn up as a result of the official investigation and which should indicate the fact of imposing a disciplinary sanction on a police officer, or refuting the fact that he committed a disciplinary offense.

Определены основные характеристики порядка применения дисциплинарных взысканий к работникам полиции. Акцентировано внимание на процедурном разнообразии порядка применения дисциплинарных взысканий к работникам Национальной полиции. Констатировано центральное значение комиссионного служебного расследования в контексте процедуры привлечения сотрудников полиции к дисциплинарной ответственности. Отмечены отдельные гарантии прав полицейских, которые существуют в процессе применения к ним дисциплинарных взысканий. Подчеркнуто положительное значение существующего порядка применения дисциплинарных взысканий к работникам Национальной полиции, показывающим стремление государства демократизировать данный процесс, сделать его максимально объективным и результативным, в первую очередь, для работника полиции.
