Мета та принципи діяльності Корпусу оперативно-раптової дії

Abstract

Досліджено теоретико-правові підходи до визначення сутності понять мети та принципів діяльності. Визначено мета та принципи діяльності Корпусу оперативно-раптової дії. Запропоновано під метою діяльності Корпусу оперативно-раптової дії розуміти забезпечення охорони прав і свобод людини при вирішенні надзвичайних ситуацій, рівень яких є надскладним для сил оперативного реагування та оперативно-розшукових підрозділів, виключно в межах своїх повноважень. Обґрунтовано, що мета діяльності КОРД тісно пов’язана з її принципами, які розглядаються як теоретичне узагальнення законів діяльності владного органу, що закріплюють основні положення та ознаки на законодавчому рівні. Охарактеризовано основні принципи діяльності Корпусу оперативно-раптової дії.

The article comprehensively investigates the theoretical and legal approaches to the defi nition of the essence of the concepts of purpose and principles of activity. The purpose and principles of the Corps of Operative-Rapid Action are determined. It is proposed to understand the purpose of the Corps of Operative-Rapid Action as the provision of protection of human rights and freedoms in the solution of emergencies, the level of which is extremely diffi cult for the forces of operational response and operational-search units, solely within the limits of its powers. It is substantiated that the purpose of the activity of the KORD is closely connected with its principles, which are considered as a theoretical generalization of the laws of the activity of the authority, which establishes the main provisions and features at the legislative level. The basic principles of the the Corps of Operative-Rapid Action are characterized. It is proposed to add the principle of professionalism and the principle of patriotism, which are not included in the normative acts concerning the activity of the KORD in the operative-abrupt action. It is substantiated, that the principles of the Corps of Operative-Rapid Action should be classifi ed into general and special. The general principles of rule of law, legality, political neutrality, and the principle of observance of human rights and freedoms are proposed. To the special – the branch principles, among which we have been allocated the following: 1) the principle of openness and transparency (taking into account the restrictions on the transparency of certain activities); 2) the principle of interaction with the population on the basis of partnership; 3) the principle of continuity; 4) the principle of professionalism; 5) the principle of patriotism.

Проведено комплексное исследование теоретико-правовых подходов к определению сущности понятий цели и принципов деятельности. Дано определение цели и принципов деятельности Корпуса оперативно-внезапного действия. Определены и охарактеризованы основные принципы деятельности Корпуса оперативно-внезапной действия.
