До характеристики нагляду і контролю за додержанням законодавства про охорону праці поліцейських

Abstract

Надано характеристику нагляду і контролю за додержанням законодавства про охорону праці поліцейських. Доведено, що за суб’єктами наглядових і контрольних повноважень слід виділити такі види: загальнодержавий, відомчий та громадський нагляд та контроль. Визначено, що метою нагляду та контролю за додержанням законодавства про охорону праці поліцейських є виявлення та усунення тих обставин, які пов’язані з невиконанням чи не належним виконанням встановлених законодавством правових, соціальноекономічних, організаційно-технічних, санітарно-гігієнічних і лікувальнопрофілактичних заходів та засобів, спрямованих на збереження життя, здоров’я і працездатності поліцейських під час виконання ними своїх службових обов’язків.

The relevance of the article is that supervision and control in management in general are necessary elements of reforms in the relevant spheres of public life. Without the exercise of control and oversight functions, the rules that establish the rights and responsibilities of the subjects of legal relations may remain insufficiently implemented. At the same time, it is expedient to know a certain limit of such control and supervision, at which the implementation of control and supervisory functions does not turn into a loss of independence of controlled and supervised entities. Supervision and control is one of the key management functions and, in essence, is an important guarantee of the implementation of police protection legislation. The article, based on the analysis of scientific views of scientists and the norms of current legislation of Ukraine, provides a description of supervision and control over compliance with the legislation on labor protection of police officers. The author’s definition of the concept of supervision and control over observance of the legislation on labor protection of policemen is offered. It has been proved that the following types should be distinguished for the subjects of supervisory and control powers: national, departmental and public supervision and control. It is emphasized that supervision and control over observance of the legislation on labor protection of police officers should be characterized as the activity of authorized by law entities, public authorities and members of the public to prevent and detect violations of legislation establishing legal, organizational, technical, financial and material, medical preventive and other measures provided by law to ensure proper working conditions for police officers, which meet the established standards for the protection of their lives and health in the performance of their duties. It is concluded that the purpose of supervision and control over the observance of the legislation on labor protection of police officers is to identify and eliminate those circumstances that are related to non-compliance or improper implementation of legal, socio-economic, organizational-technical, sanitary-hygienic and medical preventive measures and means aimed at preserving the life, health and ability to work of police officers in the performance of their duties. As a result of the implementation of supervision and control measures, it is possible to bring the perpetrators to disciplinary, administrative or criminal liability, compensation for damages.

Дана характеристика надзора и контроля за соблюдением законодательства об охране труда полицейских. Доказано, что за субъектами надзорных и контрольных полномочий следует выделить следующие виды: общегосударственный, ведомственный и общественный надзор и контроль. Определено, что целью надзора и контроля за соблюдением законодательства об охране труда полицейских является выявление и устранение тех обстоятельств, которые связаны с невыполнением или не надлежащим исполнением установленных законодательством правовых, социально-экономических, организационно-технических, санитарно-гигиенических и лечебно-профилактических мероприятий и средств, направленных на сохранение жизни, здоровья и трудоспособности полицейских при исполнении ими своих служебных обязанностей.
