Система контрольно-наглядової діяльності у сфері земельних відносин в Україні: сучасний стан і шляхи вдосконалення

Abstract

Розглянуто сучасний стан контрольно-наглядової діяльності у сфері земельних відносин в Україні. Визначено основні чинники, які впливають на ефективність такої діяльності, проаналізовано їх зміст. Окреслено основні напрямки вдосконалення системи адміністративно-правового забезпечення контрольно-наглядової діяльності у сфері земельних відносин в Україні.

The current state of control and supervisory activities in the sphere of land relations in Ukraine has been considered. The main factors that influence the effectiveness of such activities have been determined; their content has been analyzed. The basic directions of improving the system of administrative and legal provision of control and supervisory activities in the sphere of land relations in Ukraine have been outlined. It is noted that a new phase of the reform of land relations in Ukraine requires changes in the existing system of regulation and to ensure control and supervisory activities within the researched branch. Analysis of the current normative and legal acts regulating the land relations in Ukraine indicates that to solve problems that arise in the process of regulating control and supervisory activities in this sphere, require further improvement and development of the legal base, in particular making appropriate amendments and alterations into the current laws, the adoption of new laws and other legal documents aimed at regulating the control and supervisory activities in the sphere of land relations in Ukraine. The main directions of improving national legislation regulating the control and supervisory activities in the sphere of land relations have been determined. It is emphasized that improvement of the current system of control and supervisory activities in the sphere of land relations should be associated primarily with the provision of effective state control over rational use and protection of lands by guaranteeing constitutional rights on land and protection of land ownership, the rule of law in land relations, increase of efficiency of legal provision of control activities.

Рассмотрено современное состояние контрольно-надзорной деятельности в сфере земельных отношений в Украине. Определены основные факторы, влияющие на эффективность такой деятельности, проанализировано их содержание. Очерчены основные направления усовершенствования системы состояние административно-правового обеспечения контрольно-надзорной деятельности в сфере земельных отношений в Украине.
