Протидія впливу кримінальної субкультури через призму вимог міжнародно-правових актів

Abstract

У статті розглянуті питання, пов’язані з особливос­тями удосконалення правового регулювання діяльності з протидії впливу кримінальної субкультури з урахуванням позитивного досвіду зарубіжних держав у вирі­шенні зазначених проблем.

Issues, relating to the development and improvement of the ways of legal regulation of counteracting the impact of criminal subculture on social processes, have been and remain the subject of active attention of both domestic and foreign scholars. The current state and tendencies of the development of the impact of criminal subculture on the state of the rule of law not only in prisons, but in the whole in the country objectively demonstrate that traditional approaches prevailing in our country to the formation of the policy of counteracting crime, understanding the tasks and objectives of the activities in this area of public relations, methods and means of achieving them, can not provide normal lifesustaining activity of both prisoners during serving a sentence of imprisonment, and the entire population of Ukraine. Important in this context is the study and practical implementation of positive foreign experience. It is this task is crucial in all legal acts adopted recently in Ukraine aimed at counteracting crime. However, on the basis of the conducted analysis it has been stated that there is no law norms within international and legal practice, which would directly raise the issues of counteracting criminal subculture, including in prisons. Problems of criminal subculture at internationally level are associated with transnational, organized and recidivism crime, although there is not any legal barriers to the stated socially dangerous phenomenon either in general or special international and legal acts or in the national legislations of foreign countries. Most of international and legal acts relating to some extent to the scope of corrections are directed on securing fundamental rights and freedoms of a man and citizen, where prisoners are not restricted to use them under the law and the court verdict. Doctrinal models of social rehabilitation, models of justice, “distracting” programs, etc., which are specific instruments to counter the negative impact of criminal subculture are implemented abroad through these legal sources. The author has summarized that similar mechanisms and experience in Ukraine in general considering taken international commitments can be used as methodological grounds for improving the legal basis of counteracting criminal subculture both in general and in prisons, in particular.

В статье рассмотрены вопросы, связанные с особенностями со­вершенствования правового регулирования деятельности по противо­действию влиянию криминальной субкультуры с учётом позитивного опыта зарубежных государств в решении обозначенных проблем.
