Анотація
У статті проаналізовано нормативні приписи щодо права особи на сім’ю. Обґрунтовано, що формами здійснення права повнолітньої особи на сім’ю є шлюб; народження дитини чи її усиновлення, чи прийняття дитини на
виховання в сім’ю на іншій правовій підставі або фактично; усиновлення повнолітньої дитини. Підтримано пропозицію щодо розширення повноважень нотаріусів і наділення їх функціями щодо реєстрації актів цивільного
стану, в тому числі шлюбу. Запропоновано в Сімейному кодексі України як форму здійснення права повнолітньої особи на сім’ю передбачити прийомну сім’ю для осіб похилого віку.
The author of the article has analyzed the normative rules regarding a person’s right to family life. It has been proved that a person’s right to family life is recognized at national, international and legal levels. It has been argued that the forms of realizing the right of an adult to family life are marriage; the birth of a child or the adoption of a child, or the adoption of a child into a family on another legal basis or in fact; adoption of an adult child. Only a woman and a man can realize their right to family life by marrying under the current family law of Ukraine. The author has supported the proposition to extend the powers of notaries and to provide them with functions for the registration of acts of civil status, including marriage, taking into account the notary’s expertise, the availability of notarial activities. It has been proved that the residence of a woman and a man in one family, who are not married to each other or to any other marriage, is a form of realizing the right to family life by an adult, provided that such relations between the man and the woman are established, inherent in family legal relations, and in terms of their cohabitation, common household, mutual rights and obligations, rather than simply residing at the same address in one dwelling house (apartment), etc. The author has substantiated the expediency of improving the family law of Ukraine regarding the adoption of an adult in part of the possibility of adopting both an adult who was orphaned or was deprived of parental care of both parents, and an adult who was deprived of parental care of only one parent. The author has suggested paragraph 1, Part 2 of the Art. 208 of the Family Code of Ukraine in the following wording: “2. The court in exceptional cases may issue a decree about the adoption of an adult who does not have a mother, father, or has been deprived of their parental care or the care of one of them”. The author has offered to provide an adoptive family for elderly persons in the Family Code of Ukraine as a form of realizing the right of an adult to family life.
В статье проанализированы нормативные предписания о праве человека на семью. Обосновано, что формами осуществления права совершеннолетнего лица на семью являются брак; рождение ребенка или его усыновление, или принятие ребенка на воспитание в семью по другому правовому основанию, или фактически; усыновление совершеннолетнего лица. Поддерживается предложение о расширении полномочий нотариусов и наделении их функциями по регистрации актов гражданского состояния, в том числе брака. Предлагается в Семейном кодексе Украины как форму осуществления права совершеннолетнего лица на семью предусмотреть приемную семью для лиц пожилого возраста.
