Типові способи катувань як елемент криміналістичної характеристики злочину

Abstract

Проаналізовано наукові думки щодо вчення про спосіб злочину як один з основних елементів криміналістичної характеристики злочинів. Запропоновано авторське визначення способу катування. На основі аналізу наукових джерел та слідчої практики розроблено класифікацію способів підготовки, безпосереднього вчинення та приховання катувань. Висвітлено способи катувань, що вчиняються спеціальними суб’єктами.The article analyzes the opinions of scientists about the concept and importance of the method of a crime as one of the basic elements of criminal characteristics. There is proposed an author’s definition method of a torture. Thus, under the method of committing a crime, specified in the Art. 127 of the Criminal Code of Ukraine, it is proposed to understand the system of deliberate actions, consisting of preparation, committing and concealing crimes directed at the infliction of severe physical pain or mental suffering by beatings, torture or other acts of violence with the aim of forcing the victim to perform certain actions or refrain from their commitment, punishment, intimidation, discrimination of a person. There are also pointed out the objective and subjective factors, which influence the choice of a method of torture. Objective factors are the environmental conditions in which the crime is committed and subjective factors are related to mental and emotional attitude of the performer to the event. Based on the analysis of scientific sources and investigative practices there are given techniques and operations for preparation of torture, a classification of direct methods to commit and conceal torture is developed. Classification of methods of torture is carried out on such grounds as the purpose of committing a crime, motives for the crime, methods of influence and form of activity, time of consequences of the crime, as well as dependings on the direct or indirect effects on the victim. There is indicated that the concealment of the crime occurs by an action, which are directed to conceal the fact of torture as well as the further action of concealment of the crime and its traces.Проанализированы научные мнения относительно учения о способе преступления как одном из основных элементов криминалистической характеристики преступлений. Предложено авторское определение способа пыток. На основе анализа научных источников и следственной практики разработана классификация способов подготовки, непосредственного совершения и сокрытия пыток. Выделены способы пыток, совершаемых специальными субъектами.
