Анотація
Аргументовано, що юридичні гарантії діяльності Державного бюро розслідувань доцільно тлумачити як систему закріплених в нормативно-правових актах заходів, прав та обов’язків, у тому числі заборон, які реалізуються визначеним колом суб’єктів і спрямовані на забезпечення та створення необхідних умов для належного виконання територіальними управліннями завдань ДБР в межах територій, на які поширюється їх діяльність. Виділено загальні гарантії діяльності територіальних управлінь ДБР. Окрему увагу приділено юридичним гарантіям, які характеризують самостійність територіальних управлінь Державного бюро розслідувань.
It is argued that the legal guarantees of the activity of the DBR should be interpreted as a system of measures, rights and obligations laid down in normative legal acts, including prohibitions, which are implemented by a defined circle of subjects and are aimed at ensuring and creating the necessary conditions for proper implementation by territorial administrations tasks of the SBI within the territories to which their activities extend. It was emphasized that the legal guarantees of the activities of the State Bureau of Investigation include: 1) the guarantees of its pre-trial investigation, as well as the implementation of operational investigative activities, defined by special legislation; 2) guarantees of independence of the SBI from illegal influence: 3) guarantees of reduction of corruption risks, including through regulatory and legal regulation of the appropriate level of financial and social security; 4) presence of various forms of control: external, internal and public; 5) guarantees of high-quality selection of employees and their further professional development; 6) safety guarantees of employees; 7) establishment and proper regulation of factors stimulating the benevolent behavior of the employees of the DBR, including their legal responsibility. It is emphasized that such guarantees are of a general nature and cover all elements of its system. The legal guarantees characterizing the independence of the territorial administrations of the SBI are highlighted: 1) confirmation of the existence of each separate administration with the determination of the territories to which their activities are spread; 2) giving the territorial board the opportunity to independently determine proposals regarding the number of employees according to the needs of organizational and functional structural elements within the maximum number of employees; 3) requirements for the directors of the DBR, outlining the range of their powers and responsibilities; 4) drawing up an annual program of activities every year, which, taking into account the corruption, socio-economic, military, historicalgeographical and other conditions of the territories to which its activities are spread, contains a specification of tasks, their scope and order of implementation, cooperation with the public, work priorities and criteria for fulfilling the listed tasks and priorities.
Аргументировано, что юридические гарантии деятельности Государственного бюро расследований целесообразно толковать как систему закрепленных в нормативно-правовых актах мер, прав и обязанностей, в том числе запретов, реализуемых определенным кругом субъектов и направленные на обеспечение и создание необходимых условий для надлежащего выполнения территориальными управлениями задач ДБР внутри территорий, на которые распространяется их деятельность. Выделены общие гарантии деятельности территориальных управлений ДБР. Отдельное внимание уделено юридическим гарантиям, характеризующим самостоятельность территориальных управлений Государственного бюро расследований.
