Проблеми судово-психологічної експертизи дорожньо-транспортних пригод

Abstract

Визначено випадки, за яких призначається експертне обстеження стосовно водіїв автомобілів у разі виникнення сумніву у слідчого або в суді в психологічних можливостях людини, які забезпечують виконання нею функцій керування автомобілем, в ситуації з дорожньо- транспортною пригодою. Названо основні завдання, які вирішуються під час проведення таких експертиз: 1) дослідження психофізіологічного стану водія (водіїв) з метою встановлення можливості своєчасної оцінки водієм небезпечної ситуації; 2) дослідження психофізіологічного стану й дій пішохода (якщо був потерпілий); 3) дослідження індивідуально- психологічних особливостей особистості водія (пішохода).

Road traffic accidents (RTA), which caused the death of the victim, all criminal violations of safety rules occupy a significant place among other crimes. The main object of forensic psychological expertise in cases related to traffic accident is a personality in the system «man – car – environment» because of or with the assistance of which the accident has happened, breaking of equipment and loss of life have occurred. Expert inspection carried out in relation to car drivers when the investigator or the court, for example, has doubts about the psychological possibilities of man to act as a driver. The basic tasks to be solved in this case: 1) study of the psycho-physiological condition of the driver: the evaluation of opportunity for the driver to assess a dangerous situation in time; estimate of the reaction time of the driver, depending on the particular circumstances of the traffic situation that preceded the accident; research of the possibility of the driver to commit necessary actions in emergency situations; determining the possibility of misperception (misunderstanding) by driver of road conditions that prevailed before the accident; research of the possibility of preventing crashes by the driver taking into account the impact of variety of psycho-physiological of circumstances; 2) research of psycho-physiological state and activity of pedestrian (if a victim was in accident): estimate of the possibility of pedestrian of assessing hazards; evaluation of time of reaction of pedestrian depending on the specific circumstances of the traffic situation that preceded the accident; estimate of how a pedestrian should act according to the Highway Code; establishing a causal link between the actions of the pedestrian and the event; 3) study of individual psychological characteristics of a person of driver (pedestrian), which could significantly affect on the behavior, on performance of certain actions in the situation of an accident (as defined spatio-temporal situation); reconstruction of a «psychological portrait» of the subject of expertise. This type of review is one of the most difficult types of forensic psychological expertise which need further development.

Определены случаи, при которых назначается экспертное обследование в отношении водителей автомобилей при возникновении сомнения у следователя или в суде в психологических возможностях человека, обеспечивающих выполнение им функций управления автомобилем, в ситуации с дорожно-транспортным происшествием. Названы основные задачи, которые решаются при проведении таких экспертиз: 1) исследование психофизиологического состояния водителя (водителей) с целью установления возможности своевременной оценки водителем опасной ситуации; 2) исследование психофизиологического состояния и действий пешехода (если был пострадавший); 3) исследование индивидуально-психологических особенностей личности водителя (пешехода).
