Кримінологічний вимір злочинності неповнолітніх

Abstract

У статті здійснена спроба надати кримінологічну характеристику особи неповнолітнього злочинця, розглянуті причини та умови, що спонукають неповнолітніх до вчинення протиправних діянь, підкреслена необхідність прийняття комплексних заходів із протидії злочинності неповнолітніх, використовуючи їх кримінологічну характеристику.

The author of the article attempts to provide criminological characteris- tics of juvenile offender’s personality; the author has also considered the causes and conditions that encourage minors to commit illegal acts; she has stressed the need to take comprehensive measures to counteract juvenile delinquency by using their criminological characteristics. Criminological characteristics of juvenile offender’s personality includes detailed information about the juvenile (age, health status, level of development and other socio-psychological features of a person), juvenile’s attitude to committed act, the presence of adult insti- gators and other accomplices of the criminal offense, the negative inclinations (alcoholism, drug addiction, gambling), mitigating and aggravating circum - stances, the presence of causal relationships between motives, actions and con - sequences of the committed unlawful act. Research of juvenile offender’s personality from criminological position is aimed at obtaining personal data, such that characterize the social essence, criminal neglect and other data that can assist in finding and detecting the suspect, predicting the possible effects of taking measures of correction and impact. Characteristics of juvenile offender’s personality is needed not only to develop preventive, precautionary measures to combat juvenile delinquency, but also for solving crimes, because it involves obtaining personal information, which includes information on inherent anatomical, biological, psychological and social characteristics that are necessary for person’s identification, solving tactical problems and establishing actual picture of a crime in the process of its solution and investigation.

В статье предпринята попытка представить криминологическую характеристику личности несовершеннолетнего преступника, рассмотрены причины и условия, побуждающие несовершеннолетних к совершению противоправных деяний, подчеркнута необходимость комплексного принятия мер противодействия преступности несовершеннолетних, используя их криминологическую характеристику.
