Питання впровадження ювенальної юстиції в Україні

Abstract

Розглянуто можливість та доцільність запровадження в Україні ювенальної юстиції та відновного правосуддя. Акцентована увага на актуальності дослідження питань, пов’язаних із пошуком нових засобів попередження злочинності неповнолітніх. Окреслено основні проблеми, що виникають у зв’язку із запровадженням в Україні ювенальної юстиції, та запропоновано шляхи їх подолання. Спираючись на позитивний досвід зарубіжних країн та враховуючи національні потреби, зроблено висновок стосовно доцільності впровадження в Україні ювенальної юстиції.

The issues concerning the possibility and feasibility of implementing juvenile justice and restorative justice in Ukraine have been studied. They emerged and acquired the urgency not accidentally. The crisis phenomena in the social and economic spheres in Ukraine, political changes, a sharp drop in the welfare of significant number of citizens have led to an increase in juvenile delinquency and increased social tension in the society. Unfortunately, available in service measures of counteraction this negative phenomenon lose their former effectiveness over the years, do not reach the goal. Certainly, any innovations in the theory and practice of law enforcement activities cause the most lively discussions, confrontation of different points of view. Therefore, it is not necessary to talk about the unity of scientific approaches to the concept of juvenile justice and its significance for Ukraine, the positive and negative aspects of implementation in our country. This clearly evidence about indifference of the society to the studied issues. The scholars like O. M. Bronevitskaia, D. V. Yeremeiev, V. S. Katsnyr, N. M. Krestovskaia, R. M. Opatskyi and many others actively researched the issues of the possibility and feasibility of functioning juvenile justice and restorative justice in our country. The objective of this article is a clear definition of problems preventing the successful implementation of juvenile justice and restorative justice in Ukraine, which would be based on national traditions and needs of our society, rather than blindly copying international models. Special attention is focused on the need to reform the Ukrainian legislation from punitive juvenile justice to restorative according to the European standards. The author has made a positive conclusion on the feasibility of implementing juvenile justice and restorative justice in Ukraine. Herewith special attention is focused on the understanding of the institution of juvenile justice as the system of aid for children, who have committed offenses or become victims, but not a separate system of justice for children. Attention is paid to the need to achieve a positive perception of the future changes in the justice system by the society with respect to juvenile offenders, and it should be ready for this both in socioeconomic and the moral-psychological aspects.

Рассмотрены возможность и целесообразность внедрения в Украине ювенальной юстиции и восстановительного правосудия. Акцентировано внимание на актуальности исследования проблем, связанных с поиском новых способов предупреждения преступности несовершеннолетних. Очерчены основные проблемы, которые возникают из-за внедрения в Украине ювенальной юстиции, и предложены пути их преодоления. Учитывая позитивный опыт зарубежных стран и национальные потребности, сделан вывод относительно целесообразности внедрения в Украине ювенальной юстиции.
