Юридична відповідальність як явище суб’єктивного права

Abstract

Проаналізовано особливості конституційно-правової, кримінальної, адміністративної, цивільно-правової відповідальності як явищ суб’єктивного права. Встановлено основні риси юридичної відповідальності як явища суб’єктивного права, сформульовано її дефініцію.The features of constitutional and legal, criminal, administrative, civil and legal liability as phenomena of subjective law have been analyzed. It has been established that legal liability as a phenomenon of subjective law is characterized by the following features: 1) has a specific form; 2) reflects the “dynamics” of the legal form of this phenomenon is directly related to human activity; 3) is closely related to the subject of law, the behavior, consciousness, will, is personified; 4) is expressed in a particular duty of a subject of the offense to experience the negative effects of personal, property or organizational nature; 5) is implemented through the legal relations arising from the fact of violation of subjective rights (offense); 6) has an individualized procedural form depending on each case. The author has formulated the definition of legal liability as a phenomenon of subjective law – it is a type and degree of responsibilities of a subject of the offense of subjective rights (offenses) stipulated by the sanctions of law norms to suffer deprivation of personal, property, organizational nature within legal relations arising from the fact of violation of subjective rights (offense).Проанализированы особенности конституционно-правовой, уголовной, административной, гражданско-правовой ответственности как явлений субъективного права. Установлены основные черты юридической ответственности как явления субъективного права, сформулирована её дефиниция.
