Анотація
Досліджено теоретичні, правові і прикладні проблемні питання щодо забезпечення і реалізації процесуальних гарантій прав учасників кримінального провадження. Напрацьовано пропозиції і рекомендації щодо удосконалення понятійного апарату процесуальних гарантій вказаних осіб і визначенои шляхи їх вирішення. З’ясовано зміст, предмет елементів та системи процесуальних гарантій прав учасників кримінального провадження.
The scientific article is devoted to the study of current theoretical, legislative and applied issues on the definition and provision of the conceptual apparatus for procedural guarantees of protection, protection and realization of rights, freedoms and legitimate interests of participants in criminal proceedings. At the retrospective level, a comparative analysis of the current criminal procedural legislation and the departmental regulatory framework on the issues raised in the article. The scientific positions of scientists and representatives of scientific schools on the researched retrospective theoretical issues on constitutional law, theory of state and law, criminal procedural law, international, in particular, European law are analyzed. In the course of research of scientific positions of scientists and representatives of scientific schools it was found that one of the common gaps is the lack of conceptual apparatus of procedural guarantees of participants in criminal proceedings, in particular in current legislation, criminal and criminal procedure legislation, departmental and other legal framework, when it is used and applied in law enforcement activities by law enforcement agencies. Based on the results of the research and based on the results of scientific discussions, the author's vision of scientific positions in the researched direction is provided and proposals and recommendations for defining the content, essence and concept of procedural guarantees for protection of rights, freedoms and legitimate interests of participants in criminal proceedings. It is concluded that the improvement of these concepts will help investigators, investigators and prosecutors to effectively and constitutionally perform their functions to protect, protect and exercise the rights, freedoms and legitimate interests of participants in criminal proceedings, as well as identify and eliminate causes and conditions committing criminal offenses under investigation by them.
Исследованы теоретические, правовые и прикладные проблемные вопросы обеспечения и реализации процессуальных гарантий прав участников уголовного производства. Наработаны предложения и рекомендации по усовершенствованию понятийного аппарата процессуальных гарантий указанных лиц и определены пути их решения. Выяснено содержание, предмет элементов и системы процессуальных гарантий прав участников уголовного производства.
